A certain document, three copies of which are on file in the office of the Borough Secretary of the Borough of Pen Argyl, being marked and designated as the "1997 International Plumbing Code," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Plumbing Code of the Borough of Pen Argyl, Commonwealth of Pennsylvania, for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of 1997 International Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions and changes, if any, prescribed in § 82-3 of this chapter.
Chapter 82 of the Code of the Borough of Pen Argyl, entitled "Plumbing" and other ordinances or parts of ordinances in conflict herewith are hereby repealed, with the exception of Chapter 87, Sewers, of the Code of the Borough of Pen Argyl. In the event that a conflict arises between the BOCA National Plumbing Code and Chapter 87, Sewers, of the Code of the Borough of Pen Argyl, the BOCA National Plumbing Code shall be used as a guide by the Pen Argyl Municipal Authority or Borough of Pen Argyl in resolving the conflict.

The following sections of the 1997 International Plumbing Code are hereby revised as follows:
A. 
In Section 101.1 (page 1, second line), insert: "the Borough of Pen Argyl."
B. 
In Section 106.5.2 (page 4), insert the following:
1.
Permit fee: $150.
2.
Lateral, rough in and final inspections: $15 per inspection up to four units; $25 for each additional unit over four; Saturday and Sunday inspections, $25 per inspection up to four units and $25 for each additional unit over four units.
C. 
In Section 106.5.3 (page 4), deleted subparagraphs two and 3.
D. 
In Section 108.4 (page 6), insert the following:
(1) 
Seventh line: "summary offense."
(2) 
Eighth line: "$300."
(3) 
Eight line: "30 days."
E. 
In Section 108.5 (page 6), insert the following:
(1) 
Thirteenth line: "$300."
(2) 
Fourteenth line: "$1,000."
F. 
In Section 305.6.1 (page 18), insert the following:
(1) 
Second line: "48 inches."
(2) 
Fifth line: "48 inches."
G. 
Section 708 is amended to include a new Section 708.3.7, which shall read as follows:
708.3.7. Installation. Cleanouts shall be installed at the curbline of the property. (The "curbline" is defined as the boundary between the property line and the Borough street.)
H. 
In Section 904.1 (page 63), insert in the second line: "18 inches."
Nothing in this chapter or in the Plumbing Code hereby adopted shall be construed to affect any suit or proceeding impending in any court or any rights acquired or liability incurred of any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in § 82-2 of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
The Pen Argyl Borough Secretary shall certify to the adoption of this chapter and cause the same to be published as required by law, and this chapter shall take full force and effect 30 days after this date of final passage and approval.
