Sewer rentals are hereby established, which shall be payable by the owner of each EDU from and after the date upon which sanitary sewage and/or industrial waste is first discharged into the sewer system from such EDU, as follows:
A. 
Initial sewer rental. From the date of first discharge until the commencement of the next full calendar quarter, the owner of each EDU shall pay an initial sewer rental based on metered water consumption in such EDU as shown by the water meter of the public utility serving such premises, prorated, if necessary, on a daily basis, or as measured by such sewage discharge meter or device as may be approved by the Borough, in accordance with the following rates:

(1) 
For a quarterly discharge of 10,000 gallons or less, the rental shall be $114.
(2) 
For a quarterly discharge in excess of 10,000 gallons, the rental shall be $114 for the first 10,000 gallons of discharge and $13.50 for each 1,000 gallons over said 10,000-gallon quarterly discharge.

B. 
Regular quarterly sewer rentals.
(1) 
From and after the commencement of the first full calendar quarter after the date of first discharge, the owner of each rental unit, except schools, from which there shall be discharged into the sewer system any sanitary sewage and/or industrial waste, as measured or metered, shall pay a quarterly sewer rental for each such discharge in accordance with the following rate schedule:

(a)

(2) 
Schools.
(a) 
The sewer rental for collection and treatment of sanitary sewage and/or industrial waste into the sewer system from public and private schools shall be $14.26 per quarter per pupil enrolled in each school during the school year immediately preceding the date of each quarterly bill, the first quarter being due and payable on December 1, the second quarter being due and payable on March 2 and the third quarter being due and payable on May 31 of each year, there being no charge made for the fourth quarter in each year.

(b) 
Teachers, employees and supervisors in or of the school shall be classified as pupils for sewer rental purposes. For the purpose of computing quarterly charges for schools, the owner of any school shall submit a report to the Borough within seven days after the effective date of this amendment and thereafter on or before the first Monday of July of each year, stating the average daily attendance of students, teachers, supervisors and other employees for the school year then closing, and such average daily attendance shall be the basis for computing charges for such public or private school for the ensuing year. In the event that this report is not submitted as required by the amendment, the Borough shall have the right to estimate the average daily attendance of such public or private school.
C. 
Apportionment. If two or more EDUs shall be served by only one water meter, the sewage flow for each EDU, for the purpose of establishing the initial and regular quarterly sewer rentals, shall be determined by dividing the total metered water consumption for the applicable period by the number of EDUs served by such single meter.
D. 
Properties served by a well.

(1) 
Whenever any property connected to the sewer system utilizes water from a source other than that of a metered public utility, the property owner shall, at the property owner's expense, install a water meter and an outside read, or other method approved by the Borough, in order to determine the total water consumption for the applicable period. All meters installed will be fitted with a meter seal by the Borough. Tampering with the meter seal constitutes a violation of this section, subjecting the property owner to the penalties provided hereunder.
(2) 
The Borough shall have the right to read the meter, and the property owner must provide adequate access to the outside read to allow the Borough to read the water meter if it chooses. Failure to provide adequate access shall also be a violation of this section and subject the property owner to the penalties provided.
(3) 
From the effective date of this section, any property owner who is not serviced by a public utility providing water or who does not have a water meter installed as required by this section, so that the metered water consumption set forth in Subsection A hereof is not available to be read by the Borough and it is therefore not possible to measure the quarterly discharge, shall pay a minimum quarterly billing of $171.10.

E. 
An annual credit shall be provided to connection units that utilize metered water to fill swimming pools which are not discharged into the sewer system. The credit shall be calculated by subtracting the average of the lowest three quarters of metered water usage from the peak quarter of metered water usage and multiplying the resulting water usage by the applicant sewer rental category charge.
F. 
When any owner of property within the Borough or any other person shall violate this § 87-76, he shall, upon conviction thereof before any District Justice, pay to the Borough for the use of the Borough the sum of $1,000 together with costs of prosecution and reasonable attorney fees, which sum shall be collected as prescribed in the Borough Code. The sum herein forfeited shall be considered a penalty.

A. 
Quarterly sewer rentals shall be billed on the first day of each February, May, August and November and shall be due and payable immediately. If the full amount of such bill shall not be paid within 30 days from its date, 5% of the face amount of the bill shall be added thereto. Any bill which remains unpaid after 60 days from the date thereof shall be subject to a further penalty of 10% of the gross amount thereof and shall also bear interest at the rate of 1/2% per month or fraction thereof on the gross amount thereof until paid.
B. 
Every owner shall keep the Borough advised of his correct address. Failure of any owner to receive quarterly bills through neglect so to do shall not be considered an excuse for nonpayment, nor shall such failure result in an extension of the time for payment.
A. 
Methods of measuring volume.
(1) 
It shall be the responsibility of the owner of an industrial property to so measure the flow of water to the plant and/or the flow of industrial waste and/or sanitary sewage out of the plant that the volume of industrial waste and/or sanitary sewage being discharged into the sewer system may be determined with reasonable accuracy to the satisfaction of the Borough.
(2) 
If it is not practical, in the opinion of the Borough, to so measure the volume of sanitary sewage and/or industrial waste being discharged into the sewer system, then the Borough shall, in such manner and by such method as it may prescribe, estimate such volume on a per capita or other basis, which estimate shall be final for the then-current fiscal year of the Borough.
B. 
Measuring devices. Meters or other measuring devices required to comply with the above provisions shall be furnished, installed, repaired and maintained by the owner at his expense, to the extent that the same are not so furnished by a public utility, and shall be accessible to the Borough at all reasonable times for testing, inspection or repair. Should the owner fail, after notice, to keep required meters in good operating condition, the Borough may make replacements and repairs made necessary by ordinary wear and tear or other causes. Bills for such repairs, if made by the Borough, shall be due and payable immediately upon completion of such repairs and shall be collected in the same manner as quarterly bills for sewer rentals and charges.
C. 
Meter readings. The Borough shall be responsible for the reading of all meters or other measuring devices, either through its own agents or employees or through the agency of the public utility involved, and the same shall be available to the Borough at all reasonable times.
The failure of any customer to pay his bill for sewer service for a period of 30 days from the date thereof shall be cause for termination of water service. Every unpaid claim of the Borough under a bill for sewer service, together with all charges, expenses and fees added thereto for failure to pay promptly, shall, in the manner provided by law, become a lien upon the properties served and may be collected by the Borough by an action in assumpsit against the owner of such property or enforced against such property by filing a municipal claim.
