It shall be unlawful for any person or persons to lay or place or cause to be laid or placed any building material, any structures used in building, any rubbish or materials of whatever name or nature on any of the streets, roads, alleys, lanes or avenues of the Borough of Pen Argyl, or to make any hole, trench, pit or opening in any public thoroughfare so as to endanger persons or vehicles passing in, through or over same, without displaying on, about or around said building material or other material of whatever name or nature, or said opening, trench, pit or hole, sufficient light, either by signal light, lamp or lantern. All lights displayed on such obstruction or over such hole, trench, pits or openings shall be kept burning brightly from sunset to sunrise.
All building materials, temporary structures used in building, all rubbish or materials of whatever name or description, all openings, holes, trenches or pits shall at all times, day and night, be properly guarded and fenced so as to avoid accidents.
All excavations, holes, trenches, pits or obstructions on private property within the Borough of Pen Argyl, so close to the public thoroughfare as to be dangerous to persons or vehicles using the public highways of the Borough, shall at all times be suitably guarded and protected so as to avoid accidents.

Any person violating any of the provisions of this article shall, upon conviction in a summary proceeding before a District Magistrate, be sentenced to pay a fine of not more than $300 and costs of prosecution, and in default of payment of such fine and costs, to imprisonment in the county jail for not more than 30 days.
