As used in this article, the following terms
shall have the meanings indicated:
CANVASSER or SOLICITOR
Any individual, whether resident of the City or not, traveling
either by foot, wagon, automobile, motor truck or any other type of
conveyance, from place to place, from house to house or from street
to street, taking or attempting to take orders in person or by telephone
for sale of goods, wares and merchandise or personal property of any
nature whatsoever for future delivery or for services to be furnished
or performed in the future. This definition shall not apply to persons
selling by sample only, nor to any agricultural articles or products
offered for sale by the producer, nor to individuals working for health,
medical or charitable causes with permanent addresses in the City
or in Schuylkill County or persons authorized by state law.
COLD CANVASS
The uninvited telephone contact of a person by a canvasser
or solicitor not having a permanent place of business within the City.
PEDDLER
Any person who carries with him for the purpose of sale and
immediate delivery, from house to house, goods, wares and merchandise.
Exceptions to this definition of the terms "peddler," "canvasser"
or "solicitor" are the following:
A.
A person selling or making delivery of goods,
wares or merchandise theretofore sold by an establishment having a
permanent place of business within the City.
B.
A minor under eighteen (18) years of age.
C.
A person making sales of the following items
of daily household consumption:
F.
Dairy products, except dealers of frozen desserts
from vehicles.
No solicitor, canvasser or peddler shall engage in business without first obtaining a license therefor. All persons exempted under the provisions of §
164-1 must register with the Bureau of Police, but shall not be required to obtain a license or pay any fee therefor.
No person, firm or corporation shall engage
in a cold canvass within the City.
Application for a license shall be made to the
Mayor who, upon being furnished with sufficient proof that the applicant
is of good moral character, shall issue a license and shall charge
the following fees therefor:

All business done under license issued by virtue
of this article shall be conducted between the hours of 9:00 a. m.
and sunset on weekdays. No business shall be conducted on Sunday.
No peddler or any person in his behalf shall
shout, make any cryout, blow a horn, ring a bell or use any sound
device, including any loudspeaking radio or sound-amplifying system,
upon any of the streets, alleys, parks or other public places of the
City or upon any private premises in the City where sound of sufficient
volume is emitted or produced therefrom to be capable of being plainly
heard upon the streets, avenues, alleys, parks or other public places
for the purpose of attracting attention to any goods, wares or merchandise
which such licensee proposes to sell.
No person shall vend or peddle goods, wares,
merchandise, food, beverages or refreshments on a public street within
thirty (30) feet of any street intersection or from the left side
of a motor vehicle standing on the public street or to a child under
twelve (12) years of age who fails to cross a street in a lawful manner,
unless such child is accompanied by an adult. Sales shall be made
only on the sidewalk or tree lawn area of the street.
No license shall be in any manner assignable
or transferable. No license shall authorize any person, firm or corporation
other than the one named therein to do business. No licensee shall
conduct any other business than is named therein to be transacted.
Any licensee engaged in business within the
City shall carry the license and shall produce it for examination
whenever requested by any police officer or by any prospective purchaser.
Any license issued hereunder may be revoked
at any time should the person to whom it is issued be guilty of any
fraud, misrepresentation or unlawful act in connection with his business
or otherwise or found to be a person not fit to be engaged in such
business.
Any person violating any of the provisions of
this article shall be fined not more than six hundred dollars ($600.)
and, in default of payment of fine and costs, be imprisoned not more
than ninety (90) days.
