The Township of Rostraver hereby authorizes
cooperation with other municipalities in the Mon-Yough Region and
delegation of certain functions, powers or responsibilities of the
Township of Rostraver to the Twin Rivers Council of Governments on
the terms and conditions stated below.
The purpose and objectives of this article are
to foster intergovernmental cooperation, to reduce costs and to accomplish
through joint action activities which could not be accomplished individually.
The Twin Rivers Council of Governments is hereby authorized to perform
any functions, powers or responsibilities which the Township of Rostraver
requests it to perform by ordinance, resolution, motion or other action
of the Township of Rostraver.
The authority granted under this article shall
continue until the article is amended or repealed.
The Township of Rostraver hereby authorizes
the Twin Rivers Council of Governments (hereafter "TRCOG") to engage
in the following activities:
A. To create or change whatever organizational structure
is necessary to implement the functions, powers or responsibilities
of TRCOG through enactment or amendment of bylaws.
B. To levy and collect dues or other charges as necessary
to implement the functions, powers or responsibilities of TRCOG.
C. To acquire, manage, license or dispose of real or
personal property as TRCOG finds necessary.
D. To employ, discharge or discipline employees as TRCOG
finds necessary.
E. To contract with any person, entity or body as TRCOG
finds necessary.
F. To enter into contracts for policies of group insurance
and employee benefits, including social security, for its employees.
G. To engage in all other activities legally permitted
by Act 180 of 1972, Act 137 of 1986 and all other statutes and court decisions of the Commonwealth
of Pennsylvania. The enumeration of certain activities above shall
not be interpreted to limit in any way the extent of activities that
TRCOG may engage in.
The proper officials of the Township of Rostraver
are hereby authorized to take whatever action is necessary to order
to implement this article.
