A.
ASSEMBLAGE
PROCESSION
For the purpose of this chapter, the words "assemblage"
and "procession" shall have the following meanings:
A gathering of people, without vehicles, which might interfere
with the movement of pedestrian or vehicular traffic on any street
or with the normal use of any park, public square or public ground.
A group of individuals, vehicles, animals and/or objects
moving along a street in a way that might interfere with the normal
movement of traffic. A procession does not include a funeral cortege
or a military convoy.
B.
This chapter applies to processions and assemblages
that would occupy any street or sidewalk in the Township of Rostraver
or any public square, park or public ground of the Township.
C.
Insofar as this chapter applies to processions and/or
assemblages in streets and highways, its provisions shall be construed
and observed along with provisions of the Vehicle Code of Pennsylvania
[particularly Sections 6109(a)(3) and 6109(d)[1]] and of regulations and requirements of the Pennsylvania
Department of Transportation pertaining to processions and assemblages
on streets, including state-designated highways. Those state regulations
and requirements shall be strictly observed in the Township, and where
any such regulation or requirement is stricter than or in addition
to a provision of this chapter, Township personnel and persons holding
or participating in processions or assemblages subject to state requirements
and regulations shall acquaint themselves with those regulations and
requirements and observe the same, along with specific provisions
of this chapter.

A.
It shall be unlawful for any person to hold, organize or sponsor an assemblage or procession, as defined in § 133-1, unless, at least nine days in advance of the assemblage or procession, he gives written notice to the Chief of Police of the character or object of the assemblage or procession; the time, location and/or route; the expected number of persons participating in the assemblage or procession; and the names and addresses of the sponsor or organizer and/or officers of the group or organization desiring to hold the assemblage or procession.
B.
Following receipt of the notice, the Chief of Police,
subject to approval of the Board of Commissioners, shall have the
authority, and it shall be his duty, to issue a permit, which shall
be granted without fee, for the assemblage or procession.
A.
The permit referred to in § 133-2 shall specify the conditions under which it is granted, as follows:
(1)
The location of the assembly, and the route to be
followed by the procession.
(2)
The portion of any street, public square, park or
public ground to be occupied.
(3)
The estimated number of participants.
(4)
The date and the hour when the assemblage or procession
will commence and the hour when it will end or be disbanded, as the
case may be.
B.
The person to whom the permit is granted shall be
responsible for making certain that the conditions of the permit are
adhered to, and any failure to observe the conditions shall constitute
a violation of this chapter.
The Chief of Police may furnish whatever escort
may be necessary or advisable to protect persons and property and
to maintain the peace and good order of the Township.
Any person who violates any provision of this
chapter shall for every such violation, upon conviction, be sentenced
to pay a fine of not less than $50 or more than $600 and costs of
prosecution and, in default of payment of fine and costs, to undergo
imprisonment for not more than 30 days. Each violation of any provision
of this chapter, and each day on which a violation is continued, shall
constitute a separate violation. In any case when a violation is solely
a violation of a provision of the Vehicle Code[1] or of any regulation adopted by authority of the Vehicle
Code, the penalty shall be as governed by the Vehicle Code.
