Washington Township may include, pursuant to Act No. 1996-1, attorney's fees in the costs to collect any delinquent taxes, fees and municipal claims in accordance with the schedule set forth in §
44-3 of this article.
At least 30 days prior to assessing or imposing attorney's fees
in connection with the collection of a delinquent account, Washington Township
shall, by certified mail, return receipt requested, postage prepaid, mail
a notice to the property owner at the owner's last known post office
address. If within 30 days of mailing the notice the article of certified
mail is refused or unclaimed or the return receipt is not received, then at
least 10 days prior to assessing or imposing attorney's fees in connection
with the collection of a delinquent account, Washington Township shall send
another notice to the property owner at the owner's last known post office
address by first-class mail, postage prepaid. The notice to the property owner
shall include a statement of Washington Township's intent to impose or
assess attorney's fees within 30 days of mailing the notice by certified
mail or within 10 days of the mailing of the notice by first-class mail. The
notice shall also contain the manner in which the imposition or assessment
of attorney's fees may be avoided by
payment of the delinquent account.
