There shall be and hereby is established a Recreation Commission in
and for the Town of Ellicott, pursuant to the provisions of Article 13, § 243
of the General Municipal Law.
This Commission shall be appointed by the Town Board of the Town of
Ellicott and shall consist of five residents of the town, who shall serve
without pay, except for necessary expenses subject to the approval of the
Town Board. The term of office of each person shall be five years, or until
his successor is appointed and qualified, except that the members of such
Commission first appointed shall be appointed for such terms that the term
of one member shall expire annually thereafter. Vacancies in such Commission
occurring otherwise than by expiration of term shall be filled by the Town
Board for the unexpired term. The Town Supervisor shall also
be an ex officio member of the Commission.
Immediately after the appointment of the aforesaid Commission, the members
thereof shall meet and organize by electing one of the members Chairman for
a term of one year and such other officers for terms of one year as may be
necessary.
The Commission shall have the power to adopt programs and rules and
regulations for the proper conduct of public recreation, including youth and
elderly persons, and may establish, maintain and conduct supervised playgrounds,
playing fields and indoor recreation facilities owned and controlled by the
Town of Ellicott. The Recreation Commission shall have the power to conduct
any form of recreational, educational or cultural activity that would utilize,
in a constructive and wholesome manner, the free time of the people of the
Town of Ellicott. The aforesaid recreational activity may be conducted on
the town-owned or -controlled properties with the consent of the Town Board
and on private properties with the consent of the owners thereof.
The Commission shall have the power to appoint or designate a properly
qualified and trained person to act as a Recreation Director, subject to the
approval of the Town Board of the Town of Ellicott. It shall also have the
power to appoint and designate such assistant or additional personnel as may
be needed, subject to the approval of the Town Board.
The Commission shall annually submit a proposed budget to the Town Board
for official approval and ratification. The Commission may also solicit or
receive any gifts or bequests of money or personal property or any donation
to be applied principal or income, for temporary or permanent use for any
of the purposes set forth above.
The Town Supervisor shall be the custodian of the moneys made available
for expenditure and will make payments therefrom upon audit by the Town Board.
The Town Supervisor shall submit a balance of accounts quarterly to the Chairman
of the Commission. This balance will consist of the amount left in each separate
item as listed in the approved budget.
The Commission shall make an annual report to the Town Board and such
other reports as, from time to time, may be requested by said Board.
