In accordance with the authority set forth in N.J.S.A. 40A:63-7,
the Board of Commissioners hereby establishes the position of Administrator
for the City of Union City.
The City Administrator shall be appointed by the Board of Commissioners
by resolution, with no less than 2/3 of the Board voting in the affirmative.
The term of office of the City Administrator shall be at the pleasure
of the Board of Commissioners. If a vacancy shall occur as a result
of the termination of the City Administrator or for any other reason,
such vacancy shall be filled in accordance with the appointment procedure
set forth herein. The salary of the City Administrator shall be determined
and fixed by the Board of Commissioners and shall be included within
the salary ordinances of the City.
The City Administrator may be removed from office by a two-thirds
vote of the Board of Commissioners. The resolution of removal shall
become effective three months after its adoption by the Board. In
accordance with N.J.S.A. 40A:9-138, the Board of Commissioners may
provide that the resolution of removal shall have immediate effect,
provided that the City shall pay to the City Administrator any unpaid
balance of his/her salary and his/her salary for the next three calendar
months following adoption of the resolution.
It shall be the obligation of the Board of Commissioners to
select a City Administrator on the basis of his/her executive and
administrative abilities, with special emphasis on the experience,
education and training that such person has in the area of governmental
affairs.
During the absence or disability of the City Administrator,
the Board of Commissioners, by resolution, may appoint an officer
or regular employee of the City to perform the duties of the City
Administrator. If, after reasonable accommodation, the City Administrator
cannot perform the essential job functions of the office, then such
absence may be deemed a vacancy. If the reasonable accommodation imposes
an undue hardship upon the City, then such absence may be deemed a
vacancy. All absences, other than for approved sick days, shall be
without pay, unless otherwise agreed by resolution of the Board of
Commissioners.
The City Administrator shall be under the supervision, control
and approval of each member of the Board of Commissioners as it shall
relate to the departments directly under their control or responsibility.
In those instances where applicable, under the supervision, direction
and approval of the Board, the City Administrator shall have the following
duties and responsibilities:
A. To serve as the principal administrative officer representing the
Board of Commissioners. The City Administrator shall be responsible
to the Board as a whole for the proper and efficient administration
of the business affairs of the City. The City Administrator's
duties and responsibilities shall relate to the general management
of all City business, excepting therefrom those duties and responsibilities
conferred upon other City officials by state statute, other applicable
laws, rules and regulations promulgated by the state and county agencies,
decisional law or other ordinances of the City.
B. To supervise and coordinate the administration of all departments and offices, except those set forth in §
4-24, in consultation with the Commissioners of each of the respective departments.
C. To represent the City, when directed by the Board of Commissioners,
in its relations with the federal, state and county governments and
with other municipalities; and to evaluate, when requested by the
Commissioners in charge of the various departments, the City's
interest in contracts, franchises and other business transactions.
D. To study the administrative and other operations of the City and
make recommendations for plans and programs to meet the changing needs
of the City.
E. To attend all meetings of the Board of Commissioners, as required.
F. To continually review and maintain the personnel policies and practices
of the City and recommend to the Mayor and Commissioners proposed
changes for a more efficient operation of the City.
G. To recommend the nature, location and extent of public improvements
in conjunction with the appropriate department head and to coordinate
the execution of same when authorized by the Mayor and Board of Commissioners.
H. To implement and enforce the policies of the Mayor and Board of Commissioners
with respect to the compiling and release of public information.
I. To receive from each department, office and board their annual budget
requests and to review and transmit same, along with his/her comments
and recommendations, to the Mayor and Board of Commissioners.
J. To consult with the Mayor, Commissioner of Revenue and Finance, the
City Auditor and the Chief Financial Officer on the preparation of
the tentative budget, record changes, additions and deletions thereof
and to submit the final recommendations made by the Administrator,
in coordination with the Mayor, Commissioner of Revenue and Finance,
City Auditor and Chief Financial Officer, in the form required by
law, together with an analysis of the various items of expenditure
and revenue and such explanatory comments as may be required.
K. To maintain a continuing review of the City's insurance program
with the insurance representatives for the City and recommend to the
Board of Commissioners any changes or modifications to the plan of
insurance in force at that time.
L. To assist the Board of Commissioners in negotiating contracts for
the City, as authorized by and subject to the approval of the Board
of Commissioners.
M. To act as a liaison on behalf of the City with all utility companies
serving any portion of the City to be sure that such utilities are
providing adequately for the needs of the residents of the City.
N. To assure that the provisions of all franchises, leases, permits
and privileges granted by the City are complied with.
O. To investigate and pursue federal and state aid projects and other
aid programs for which the City may qualify, including the administration
of all community development grants, whether state or federal.
P. To require each department to maintain adequate inventory records
of all equipment and materials owned and used by the City, and to
arrange for the disposal of all inadequate or obsolete materials when
directed to do so by the Board of Commissioners.
Q. To keep the Board of Commissioners currently informed of all matters
within his/her jurisdiction by such reports, verbally or in writing,
as (s)he deems advisable or as may be requested by the Commissioners,
and to submit an annual written report of his/her work accomplished
at the request of the Commissioners for the benefit of the public.
R. To see that all money owed to the City is promptly paid, and that
the proper proceedings are taken for the security and collection of
all of the City's claims.
S. To execute and enforce the laws of the State of New Jersey and ordinances
and resolutions of the City in such a manner as the Commissioners
may prescribe.
T. To supervise the work of consultants retained by the Board of Commissioners,
such as engineers, planning consultants and others, and to keep the
Commissioners fully informed as to the work of such consultants.
U. To perform such other duties as may be assigned to him/her from time
to time by the Mayor and/or members of the Board of Commissioners.
The City Administrator shall not supervise or coordinate the
administration of the Police and Fire Departments. These departments
shall remain under the control and direction of the Commissioner of
the Department of Public Safety.
The City Administrator shall devote full time to the interests
of the City.
Pursuant to N.J.S.A. 40A:9-136, the person appointed as City
Administrator may be someone other than a resident of the City.
Nothing in this article shall derogate from or authorize the
City Administrator to exercise the powers and duties of the elected
and appointed officials of the City.
