Except when necessary to avoid conflict with
other traffic or to protect the safety of any person or vehicle, or
in compliance with law or the direction of a police officer or other
authorized person, or official traffic control device, the following
prohibitions shall be in effect:
A. Stopping, standing or parking of a vehicle is expressly
prohibited under the following circumstances:
(1) On the roadway side of any vehicle stopped or parked
at the edge or curb of the street.
(5) Between a safety zone and the adjacent curb within
30 feet of points on the curb immediately opposite the ends of a safety
zone.
(6) Alongside or opposite any street excavation or obstruction
which obstructs traffic.
(7) Upon any bridge or other elevated structure.
(8) On public or private property which is expressly reserved
for handicapped persons or disabled veterans, when said property has
been posted in accordance with the regulations of the Pennsylvania
Department of Transportation.
(9) Fire lane no parking, standing or stopping zones:
(a)
The Township Fire Marshal shall establish no
parking, standing or stopping zones in those areas where parked vehicles
may impede the progress, access, ingress and egress of fire equipment,
ambulances, or other emergency vehicles and equipment from residential
or commercial buildings.
(b)
The Township Fire Marshal is further directed
to post the aforementioned areas with signs reading "No Parking By
Order of the Fire Marshal."
(c)
After said areas are posted, the Fire Marshal
shall maintain a complete listing physically describing such areas
posted, which areas shall immediately thereafter be ordained as no
parking, standing or stopping areas.
(d)
Thereafter, any vehicle found in violation of
any fire lane removed from said area. The registered owner or operator
of said vehicle shall be promptly notified of the fact of the removal
and the place to which said vehicle has been removed, where he or
she may obtain same upon payment of all towing and storage charges.
(10)
At any place where official signs prohibit same.
B. Standing and parking of vehicles is expressly prohibited
under the following circumstances:
(1) In front of a public or private driveway.
(2) Within 15 feet of any fire hydrant.
(3) Within 20 feet of a crosswalk at an intersection.
(4) Within 30 feet of any flashing signal, stop sign,
yield sign or traffic control signal located at the side of a roadway.
(5) Within 20 feet of the driveway entrance to any fire
or ambulance station, or when properly posted, on the side of the
street opposite to any fire or ambulance station within 75 feet of
the entrance.
(6) Any place where official signs prohibit same.
C. Parking a vehicle is expressly prohibited under the
following circumstances:
(1) Within 50 feet of the nearest rail of a railroad crossing.
(2) Any place where official signs prohibit parking on
the opposite side of the street/roadway.
D. Exceptions. The following are exceptions to the restrictions
set forth in this section:
(1) The Chief of Police of the East Brandywine Township
Police Department, or his or her designee, may authorize parking in
any area which would otherwise be prohibited.
The provisions of this article are severable.
If any section, sentence, clause or phrase of this article is determined
to be illegal, invalid or unconstitutional by any court of competent
jurisdiction, such decision shall not affect or impair the remaining
sections, sentences, clauses or phrases of this article. It is hereby
declared as the intent of the Board of Supervisors that this article
would have been adopted had such invalid or unconstitutional section,
clause, sentence or phrase not been included herein. Furthermore,
it is the intent of this article to be supplementary to and not contrary
to any laws of the Commonwealth of Pennsylvania or regulations of
any of its agencies.
