A code regulating the sanitary and safety conditions for recreational
bathing places and to preserve and improve the public health, providing
for the inspection of such recreational bathing places; and the fixing
of fees is hereby established pursuant to N.J.S.A. 26:3-69.1 et seq.
A copy of the code is made a part hereof without the inclusion of
the text herein.

The code established and adopted by this chapter is the regulations
promulgated by the State Commissioner of the Department of Environmental
Protection pursuant to N.J.S.A. 26:1A-7, which regulations are described
and commonly known as the "Public Recreational Bathing Code" and which
are set forth in N.J.A.C. 8:26-1.1 et seq., as amended and supplemented.

Three copies of the public recreational bathing regulations
set forth at N.J.A.C. 8:26-1.1 et seq. have been placed on file in
the office of the Secretary of the Board of Health for the use and
examination of the public.

No person shall, within the Township of Bernards, operate or
allow to be operated a recreational bathing place or facility, as
defined in N.J.A.C. 8:26-1.1 et seq., without first having obtained
a license or licenses from the Board of Health in such form or forms
as the Board may from time to time issue.

The description and duration of each such license and fees for the same shall be as set forth in Chapter BH:15 of the Revised Ordinances of the Board of Health of the Township of Bernards, New Jersey.

The penalty for any violation of this chapter shall be as set
forth in Section BH:15 of the Revised Ordinances of the Board of Health
of the Township of Bernards, New Jersey.
