The purpose of this chapter is to create the
Menominee Tribal School Board of Education to oversee the administration
of the Menominee Tribal School and to list the powers and duties of
the School Board.
As used in this chapter, the following terms
shall have the meanings indicated:
MENOMINEE TRIBAL SCHOOL
The school for kindergarten through eighth grade which is
located in Neopit, Wisconsin, owned and operated by the Menominee
Indian Tribe.
QUORUM
A minimum of three members of the five-member Board.
SCHOOL ADMINISTRATOR
The person employed by the Menominee Indian Tribe to run
the day-to-day operations of the Menominee Tribal School.
SCHOOL BOARD
The Menominee Tribal School Board of Education created by
this chapter.
TRIBE
The Menominee Indian Tribe of Wisconsin.
It shall be the duty of the School Board to:
A. Maximize the educational opportunities available for
students of the Menominee Tribal School.
B. Consult and advise the School Administrator on issues
related to the operation of the Menominee Tribal School.
C. Assure adherence to Menominee Tribal School Policies
and Procedures.
D. Interpret Ordinance No. 83-6, Menominee Nation Personnel
Policies and Procedures.
E. Develop amendments to Ordinance No. 83-6, Menominee
Nation Personnel Policies and Procedures, as they relate to the operation
of the Menominee Tribal School with the intent of maximizing functions
of an educational setting. The Menominee Tribal Legislature must approve
all such amendments.
F. Supervise and evaluate the School Administrator. The
School Board shall have all the powers of a supervisor pursuant to
Ordinance No. 83-6. Hiring of a School Administrator shall be done
in accordance with Ordinance No. 83-6. The School Board shall appoint
two of its members and one Menominee Tribal School employee to interview
any prospective candidates for the School Administrator along with
one human resources representative and one administrative service
officer or administrative manager.
G. Submit an annual budget to the Menominee Tribal Legislature
for approval.
H. Ensure the School Administrator meets monthly with
the Labor, Education, and Training Committee, or any future legislative
committee which deals with education, for the purpose of creating
a collaborative effort that promotes a cohesive educational system
on the Reservation.
I. Conduct expulsion hearings upon recommendations from
the School Administrator and hear appeals from students and parents
in accordance with the policies of the Menominee Tribal School and
all applicable tribal, federal and state rules and regulations.
J. Draft bylaws governing the conduct of School Board
meetings. Those bylaws must be approved by the Menominee Tribal Legislature.
K. Approve the curriculum to be used in the Menominee
Tribal School.
L. Enact or revise any Menominee Tribal School policy(ies)
except for personnel policies which are governed by Ordinance No.
83-6.
M. Negotiate terms of standard teacher contracts or other
Menominee Tribal School employee contracts.
N. Consult with the administrative service officer assigned
to the Menominee Tribal School for technical assistance in regard
to contract funding to ensure funding compliance.
O. Ensure Menominee Tribal School compliance with Chapter
7, Accounting System, of this Code.
