No person shall discharge, nor shall any person have in his possession any loaded firearm, crossbow, slingshot, air gun, spring gun, gas gun or weapon of any other kind, nature or description while within 600 feet of any occupied dwelling, school, school playground, or municipal park or building within the City of Linwood. The provisions of this section shall be subject to §
145-2.
Section
145-1 of this chapter shall not apply to:
A. Law enforcement officers of any governmental agency while
in the performance of their duties.
B. Members of any legally recognized military organization
while in the performance of their duties.
C. Members of government or civilian rifle or pistol clubs
duly organized in accordance with the rules prescribed by the National Board
for the Promotion of Rifle Practice or the National Rifle Association, in
going to or from their several places of target practice, and carrying firearms
necessary for such practice, provided such firearms are unloaded, and in discharging
firearms as part of such practice, provided that a copy of the club charter
is filed with the Chief of Police and that the practice range, if within the
City, is approved by the Chief of Police as complying with the nationally
recognized standards for such ranges.
D. Privately employed security personnel who are authorized
by law to carry firearms, while in the performance of their duties.
E. Persons engaged in skeet or trap shooting on ranges approved
by the Chief of Police as complying with recognized standards for such ranges.
F. Persons lawfully using firearms or other weapons in the
protection of person or property.
