This article shall be retitled "Ballpark Regulations."
The purpose of this article is to provide regulations
governing the use of tribally owned and/or operated ballparks.
As used in this article, the following terms
shall have the meanings indicated:
BALLPARK
Any tribally owned and/or operated ballpark within the exterior
boundaries of the Menominee Indian Reservation.
DIRECTOR
The Director of the Department or his or her designee.
ORGANIZATION
Any amateur or professional athletic association or team.
ORGANIZER
An individual responsible for coordinating a game or other
athletic activity.
VENDOR
The license or permit holder for the sale of alcoholic beverages
and cigarettes.
The Menominee tribal police shall have the authority
to issue citations for the following violations of this article:
A. Whoever sells, distributes or otherwise consumes alcoholic beverages at any ballpark where the sale and or consumption of alcoholic beverages has been prohibited by the Director or pursuant to §
444-4E shall be escorted off the premises and subject to a forfeiture of $25.
B. Any vendor who sells cigarettes or alcohol without
having furnished a copy of his or her permit to the Department shall
be escorted off the premises and subject to a forfeiture of $25.
C. Whoever fails to comply with the provisions of this
article may be denied future use of any ballpark.
D. Whoever loiters, idles or remains on a ballpark after
11:00 p.m. shall be subject to a forfeiture of $15.
