The provisions and requirements of these regulations shall be
adhered to by any and all residents and nonresidents of the Menominee
Indian Reservation.
As used in this article, the following terms shall have the
meanings indicated:
SCAVENGING
Salvaging, collecting, or picking material from discarded
solid waste at all solid waste disposal sites for use, reuse or sale
by the individual, group or business.
SOLID WASTE
Garbage, refuse, or other waste material, including liquid
waste, generated from business and living activities.
It shall be illegal for any individual, group, or business,
whether resident or nonresident, to:
A. Scavenge at any solid waste disposal site on the Menominee Indian
Reservation. This restriction shall not apply to any individual or
business who or which has a contract with the Menominee Indian Tribe
to collect, remove, dispose or recycle solid waste, metals or materials
and who or which is acting within the scope of his or its contract.
B. Dispose of any solid waste on any land outside of the designated
solid waste disposal sites. Disposal of solid waste shall be permitted
on special days at hours which shall be posted at sites.
It shall be the duty of the Menominee Tribal Police Department
and any of its designated deputies or officers and the Department
of Conservation to enforce the provisions of this article.
Violations of this article will result in the following penalties:
A. First violation: a forfeiture of $100 to be paid to the Tribal Court.
B. Second violation: a forfeiture of $300 to be paid to the Tribal Court.
C. Third and subsequent violation: a forfeiture of $500 to be paid to
the Tribal Court.
