Any building or any appurtenance or fixture connected therewith, or any window, sign, showcase, showbill, step, porch, platform, cellar door, covering (except a cloth awning having an elevation of at least seven feet above the sidewalk) or fence, or any other structure, obstruction or encroachment of any kind, which shall now or hereafter be erected or constructed or maintained, or any goods, wares or merchandise placed or maintained, contrary to the provisions of §
216-27 shall forthwith be removed by the person erecting, constructing or maintaining it, upon notice, in writing, from the Director of Public Works so to do. In the event of the refusal or neglect of such person to remove such building or other obstruction or encroachment after such notice, the Director of Public Works may remove it or cause it to be removed at the expense of the person erecting, constructing or maintaining it.

A. Causing or maintaining an obstruction or encroachment upon or across a public right-of-way or other public property without having a permit therefore as required by §
216-27 shall be a violation of this article, regardless of the failure by the Director of Public Works to issue a notice to remove same and regardless of compliance with such a notice if given.
B. It shall be unlawful for any person to place, install
or erect any structure or to obstruct the free and lawful passage
of pedestrians on the sidewalks by placing thereon any goods, wares,
recreation structures or other merchandise or articles for trade and/or
sale or storage within any Township, county or state right-of-way
area or within or upon any roadway. This would include but not be
limited to basketball poles, hockey nets or other sports-related equipment
and dumpsters or other waste, trash or demolition materials.
C. Each day such obstruction or encroachment remains
without benefit of permit shall be a separate violation.
D. No permit shall be issued as provided by §
216-27 for basketball poles, hockey nets or sports-related equipment.
Violations of the provisions of this article shall be punishable as provided in Chapter
1, General Provisions, Article
I.
