In order to protect and preserve the public safety, property, health and welfare of the Menominee Nation and assist the Menominee Tribal Department of Environmental Services and the County of Menominee Highway Department, it is the intent of the Tribal Legislature to provide for a proper and timely manner of snow removal upon the streets and highways within the exterior boundaries of the Menominee Nation.
A. 
Pursuant to Article I of the Constitution and Bylaws of the Menominee Indian Tribe, the governmental powers shall extend to all persons and subjects, to all lands and other property, including natural resources, and to all waters and air space within the exterior boundaries of the Menominee Indian Reservation. Pursuant to Article III, Section 1, the Tribal Legislature is vested with the power to make and to enforce laws.
B. 
This article shall be enforced by any duly authorized Menominee tribal police officers and Menominee tribal conservation officers.

As used in this article, the following terms shall have the meanings indicated:
MOTOR VEHICLE
Any automobile, truck, trailer, semitrailer, tractor, motor bus or any self-propelled or motor-driven vehicle, except a motorcycle, moped, or motor bicycle.

PUBLIC HIGHWAY
Every public street, alley, road, highway or thoroughfare of any kind open to public travel and use.
It shall be unlawful to park any motor vehicle on any public highway within the exterior boundaries of the Menominee Nation between the hours of 12:00 midnight and 7:00 a.m. from November 15 to April 15 of each year, to permit snow removal.
This article shall not rescind, supersede or amend the provisions of Article I of this chapter which adopt the entire Wisconsin Motor Vehicle Code (and any amendments that occur from time to time) under § 349.13(1g), (1m), (2), (3), (3m) and (5), Wis. Stats., Authority to regulate the stopping, standing or parking of vehicles. However, in lieu of the penalties mandated by Article I of this chapter, violating any provision of this article shall be subject to fines of not more than $10 plus court costs for the first offense and $20 plus court costs for each subsequent conviction.
