The Village Board of the Village of Monticello, Sullivan County,
New York, does hereby enact this chapter pursuant to the authority
and provisions of § 7-725-a of the Village Law and the Municipal
Home Rule Law.
This chapter shall be known as the "Village of Monticello Site
Plan Review Law." The Village of Monticello is hereinafter referred
to as the "Village."
Through site plan review, it is the intent of this chapter to
promote the health, safety and general welfare of the residents of
the Village and to ensure that proposed development and use of land
within the incorporated limits of the Village of Monticello will have
a harmonious relationship with the existing or permitted use of contiguous
land and of adjacent neighborhoods; to ensure that the health, safety,
welfare, comfort and convenience of the public is fully considered;
to assure that necessary provisions are made for traffic generation,
circulation and parking, means and location of access, screening,
signs, landscaping, lighting, architectural features, location and
dimensions of buildings, impact of the proposed use on adjacent land
uses, recreation, water supply, storm drainage, sanitary sewers or
alternative wastewater treatment and disposal, solid waste and emergency
services. It is further the intent of this chapter to ensure the optimum
overall conservation, protection, preservation, development and use
of the natural and human-related resources of the Village by regulating
land use activity within the Village through review and approval site
plans. It is not the intent of this chapter to prohibit any land use
activity but to allow all land use activities that will meet the standards
set forth herein and conform to all other applicable regulations.
The Planning Board is hereby authorized to review and approve,
approve with modifications or disapprove site plans for land uses
within the Village as hereinafter designated pursuant to and in accordance
with the standards and procedures set forth in this chapter.
