This chapter is intended to establish regulations pertaining to the placement of temporary toilets within the Borough. As used herein, a "temporary toilet" shall be defined as a toilet facility provided at a construction site or at certain public functions, either on public or private property.
No person shall install, place or construct a temporary toilet facility on any property within the Borough unless a permit shall be obtained in accordance with the provisions of this chapter.
An application for the installation and placement of a temporary toilet shall be made in writing to the Property Maintenance Officer. The application shall provide the following information:
A. 
The name, address and telephone number of the applicant for the permit.
B. 
The name, address and telephone number of the company providing the toilet facility, together with the name and contact number, if different, for the purpose of communicating in the event of an emergency.
C. 
A statement detailing the need for the toilet facility.
D. 
The name, address and telephone number of the property owner and the written consent thereof.
E. 
The date that the toilet facility will be installed and the estimated date that it will be removed.
The following standards shall apply to toilet facilities:
A. 
A permit for a toilet facility shall be valid for a period of 120 days from the date of its issuance.
B. 
The toilet facility shall be located at least 100 feet from the right-of-way and at least 15 feet from any property line. The door of the facility shall face the interior of the property and shall not be visible from adjoining properties and rights-of-way.
C. 
The toilet facility shall be locked and inaccessible at all times when no activity is occurring on the site, provided however that same shall be inaccessible on construction sites after 8:00 p.m.
D. 
The party receiving a permit for the placement of the toilet facility shall be responsible for its maintenance, cleaning and emptying at a minimum of every 10 days, or sooner if necessary, to eliminate any odors or other health hazards.
This chapter shall be enforced by the Borough Property Maintenance Officer, Borough Construction Code Official and the Board of Health. Such officials shall be entitled to revoke a permit should there be any violation of any provision of this chapter.
Fees for the issuance of a permit for the toilet facility shall be $50. An extension of the permit beyond the initial period shall require payment of an additional permit fee of $50.
For violation of any provision of this chapter, the maximum fine shall be in accordance with § 1-15 of the Borough Code. Each and every day in which a violation of any provision of this chapter exists shall be deemed a separate violation.
