There shall be and is hereby established in said Township of Greenwich a department to be known as the "Water Department," the same being under the supervision, management and control of the Township Council of the Township of Greenwich.
At the annual meeting of the Township Council of the Township of Greenwich in January of each year, there shall be appointed by said Township Council one person to serve as Water Clerk and one person to serve as Water Superintendent, and both persons shall hold their offices respectively for the term of one year and until their successors are duly appointed and qualified. The Water Superintendent shall be licensed by the State of New Jersey in accordance with the statutes made and provided. The annual salaries[1] of the Water Clerk and Water Superintendent shall be fixed by ordinance of the Township Council, and said salaries shall be payable as provided by the terms of said ordinance and shall be in lieu of any fees of every description received by said officers through their offices.

The Water Superintendent shall make written monthly reports to the Township Council (or oftener if so requested by said Council) of the general condition of the waterworks, mains, machinery and everything appertaining to the running and operation of said waterworks. The Water Clerk shall make reports to the Township Council whenever requested to do so by said Council. Both the Water Clerk and Water Superintendent, as well as all water officers and employees of the Water Department, will be held strictly responsible for the performance of the duties and powers delegated to them. They shall not vary from nor exceed the instructions given or the powers conferred upon them by the Township Council or their superiors.
The chief executive officer of the Water Department shall be the Water Clerk. He shall have immediate control and management of the Water Department. It shall be the duty of the Water Clerk of the Water Department to make out all bills for water rents and collect the same when due; he shall be the Clerk of said Township Council when it is acting as the Water Committee, and shall perform such other duties as it may require of him and record all its proceedings when acting in its capacity as the Water Committee or the Water Department, and shall keep all books of accounts connected with the carrying on of said waterworks.
The Water Superintendent shall exercise general supervision of the operation and maintenance of the water plant, including machinery, equipment, mains, supply pipes and other mechanical features appertaining thereto, and shall execute all orders of the Township Council appertaining to his duties and the general management of the waterworks. He shall incur no debt on the account of the Township of Greenwich or its Water Department unless authorized by the Township Council, nor shall he dispose of any material or property of said Township appertaining to said waterworks without first obtaining, in writing, the consent of the Township Council or a majority of its members. He shall keep suitable books of record in which he shall cause to be entered all work done in carrying on said waterworks and all materials purchased and sold, all water service and connections made and all houses in which the water from said works is used, as well as those in which the same is not used, and he shall also promptly execute, under the supervision of the Water Clerk when requested, all rules and regulations of the Township Council, whether relating to the Water Department or whether contained in this chapter or not, against all those who shall fail to pay their water rents promptly.
The persons engaged as Water Clerk and Water Superintendent at the time of final passage of this chapter, or who carry out the duties assigned to said offices at said time, shall continue in office until the annual meeting of the Township Council in January 1960, when a Water Clerk and Water Superintendent shall be appointed as hereinbefore provided, except that where either the Water Clerk or Water Superintendent is presently holding tenure of office, he shall continue his office, notwithstanding the provisions of this section.
