This chapter shall be known and may be cited
as "The Stormwater Management Ordinance."
The Stormwater Management Act, P.L. 1981, c.32,
which amends and supplements the Municipal Land Use Law, N.J.S.A.
40:55D-1 et seq. and N.J.S.A. 40:55D-93, authorizes municipalities
to revise stormwater control ordinances as needed.
It has been determined by NJDEP that secondary
impacts of development in those portions of Greenwich Township which
are within the sewer service area require the establishment of a water
quality management planning goal of no net increase with respect to
both stormwater quantity and pollutant loadings affecting the areas.
Furthermore, NJDEP's consideration of Greenwich Township's 2001 Wastewater
Management Plan submission requires that Greenwich Township shall
take all steps necessary to require applicants for site plan and/or
subdivision approval for development of areas of one acre or more
that qualify as "projects" under N.J.S.A. 4:24-39 et seq. to submit
for NJDEP approval a plan for achieving, to the extent practicable,
a goal of no net increase in stormwater runoff or pollutants.
The purpose of this chapter is to establish
for those portions of Greenwich Township within the sewer service
area, stormwater management regulations which require, as a condition
of municipal approval, that certain applications for development covered
by this chapter include a stormwater management plan (plan) which
will achieve, to the extent practicable, a goal of no net increase
in stormwater runoff and pollutant loads. The purpose of the plan
is to provide for a comprehensive strategy for control of stormwater
impacts within the sewer service area. Such a strategy will provide
the greatest benefit when both structural and nonstructural controls
are integrated in a comprehensive plan. The plan shall be developed
with the concept that stormwater management is most effective when
a series of controls are used including preventive site planning,
source controls and nonstructural systems which emphasize natural
drainage, with only secondary consideration given to the use of larger
structural drainage facilities for reducing runoff pollutants and
flow.
The provisions of this chapter shall be applicable
to all major site plan or major subdivision applications affecting
property within the sewer service area, as defined in the Greenwich
Township Wastewater Management Plan, currently under review with the
NJDEP. Applicants shall demonstrate as an item of completeness whether
the subject property is within the sewer service area.
This chapter is intended to amend the Stormwater
Management Ordinance of the Township of Greenwich, which ordinance
continues to be applicable to the types of developments regulated
by it.
