As used in this chapter, the following terms shall have the meanings indicated:
BICYCLE
A vehicle with two wheels propelled by pedals or with a motor.
SKATEBOARD
A vehicle consisting of a narrow board mounted on wheels and propelled by human power or with a motor.
A. 
It shall be unlawful for any person to ride or drive a bicycle or a motorized version of a bicycle upon the sidewalks within the business district (Zones TZ and DC) of the Borough of Brookville.
B. 
It shall be unlawful for any person to ride or drive a skateboard or a motorized version of a skateboard upon the streets or sidewalks within the business district (Zones TZ and DC) of the Borough of Brookville.
C. 
It shall be unlawful for any person to ride or drive a skateboard upon any public street or thoroughfare of the Borough.
D. 
It shall be unlawful for any person to ride or drive a bicycle on the sidewalks within the business district (TZ or DC Zones) of the Borough at any time. Bicycles shall be permitted to ride upon all streets within the Borough, including the business districts, as long as they conform to the laws of the commonwealth.
E. 
It shall be unlawful for any person to ride or drive a bicycle or skateboard upon any private property without permission of the property owner.
Any person riding or driving a bicycle or skateboard shall:
A. 
Obey the instructions of a police officer or other appropriately attired person authorized to direct, control or regulate traffic.
B. 
Obey traffic and pedestrian control signals as provided under any Pennsylvania Motor Vehicle section, including, but not limited to, Section 3112 (relating to traffic control signals) and Section 3111 (relating to pedestrian control signals), or any Borough ordinance or resolution.
C. 
Yield the right-of-way to any pedestrian and may not overtake or pass a pedestrian.
No person shall suddenly leave a curb, sidewalk, berm or street or any other place to ride or drive into or toward the path of a vehicle which is so dose as to constitute a hazard.
No person shall place a ramp, half-pipe or other structure in or about any thoroughfare, street, sidewalk or parking lot.
A. 
First offense. Any item used In violation of this chapter shall be impounded by the Police Department for a period not exceeding 30 days. If the person violating this chapter is a minor, in addition to the confiscation of the item, the Borough Police shall notify the parent, guardian or other person having legal custody of said minor of the violation of this chapter and the impounding and provide such individual with a copy of this chapter.
B. 
Second and/or subsequent offense. Any item used in a second or subsequent offense in violation of this chapter shall be impounded for a period not exceeding 60 days. Said person shall, upon conviction, be sentenced to pay a fine of $10, plus costs. In the event said person is a minor, the parent, guardian or other person having legal custody of said minor shall, upon conviction, be responsible for said fine and costs.
