The Fire Chief, Village Code Enforcement Officer and each of the duly appointed electrical inspectors of the New York Board of Fire Underwriters, Middle Department Inspection Agency, Inc., Commonwealth Electrical Inspection Service, Inc., New York Atlantic-Inland, Inc., and Kevin Lauper are hereby authorized and deputized as agents of the Village of Horseheads to make inspections and reinspections of all electrical installations heretofore and hereafter described and to approve or disapprove the same. In no event, however, will the cost or expense of such inspections and reinspections be a charge against the Village of Horseheads.
A. 
It should be the duty of the electrical inspector (inspectors) to report, in writing, to the Code Enforcement Officer of the Village of Horseheads, whose duty it shall be to enforce all provisions of this chapter and the New York State Uniform Fire Prevention and Building Code adopted January 1, 1984, and as hereafter amended (herein referred to as "code"), all violations or deviations from or omissions of the electrical provisions of the code applicable to the Village of Horseheads and of all local laws, ordinances and resolutions as referred to in this chapter insofar as any of the same apply to electrical wiring. The electrical inspector shall make inspections and reinspections of electrical installations in and on properties in the Village of Horseheads upon the written request of an authorized official of the Village of Horseheads or as herein provided.
B. 
The electrical inspector is authorized to make inspections and reinspections of electrical wiring installations, devices, appliances and equipment in or on properties within the Village of Horseheads where it is deemed necessary for the protection of life and property. In the event of an emergency, it is the duty of the electrical inspector to make electrical inspections upon the oral request of an official or officer of the Village of Horseheads.
C. 
It shall be the duty of the electrical inspector to furnish written reports of his or her inspection to the proper officials of the Village of Horseheads and owners and/or lessees of the property, particularly where defective electrical installations and equipment are found upon inspection. He or she shall authorize the issuance of a certificate of compliance when electrical installations and equipment are in conformity with the code. He or she shall direct that a copy of the certificate of compliance be sent to the Village of Horseheads to the attention of the Code Enforcement Officer.
The Village Board reserves the privilege of appointing such other and future inspectors, in addition to those firms identified in § 129-1 hereof, as it deems necessary. Such appointment may be made by resolution of the Board at a duly called meeting thereof.
This chapter shall not relieve from or lessen the responsibility of any person owning, operating, controlling or installing any electrical wiring, devices, appliances or equipment for loss of life or damage to persons or property caused by any defect therein, nor shall the Village of Horseheads be deemed to have assumed any such liability by reason of any inspection made pursuant to this chapter.
A. 
It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed or to alter electrical wiring for light, heat or power in or on properties in the Village of Horseheads until an application for inspection has been filed with the New York Board of Fire Underwriters, Middle Department Inspection Agency, Inc., Commonwealth Electrical Inspection Service, Inc., or New York Atlantic-Inland, Inc. It shall be a violation of this chapter for a person, firm or corporation to connect or cause to be connected electrical wiring in or on properties for light, heat or power, or to any source of electrical energy supply, prior to the issuance of a temporary certificate or a certificate of compliance by the New York Board of Fire Underwriters, Middle Department Inspection Agency, Inc., Commonwealth Electrical Inspection Services, Inc., or New York Atlantic-Inland, Inc.
B. 
Any person, firm or corporation or others violating any provision of this chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be subject to a fine not exceeding one thousand dollars ($1,000.) or to imprisonment not exceeding one (1) year, or both such fine and imprisonment, for each and every violation and for each week and every week that such violation continues. In addition, such party may be subject to civil action; the village may recover a penalty of one thousand dollars ($1,000.) for each violation. Each week such violation continues shall be the basis for a separate action. The Village Board may also maintain an action or proceeding in the name of the village in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of the aforesaid chapter notwithstanding that the chapter may provide a penalty for punishment for such violations.[1]
