As used in this article, the following terms shall have the meanings
indicated:
DPW
The Department of Public Works, Village of Scottsville.

MAJOR EVENT
An event of sufficient size or length that will require extensive
use of law enforcement, fire, emergency medical or DPW resources.

MOTORCADE
An organized procession, except funeral processions, upon any public
street, sidewalk or alley.
PARADE
Any march or procession consisting of people, animals or vehicles,
or combination thereof, except funeral processions, upon any public street,
sidewalk or alley, which does not comply with normal and usual traffic regulations
or controls.
PUBLIC ASSEMBLIES
An assembly of persons upon any public street, sidewalk or alley
which impedes or tends to impede pedestrian or vehicular traffic.
PUBLIC SAFETY PLAN OF OPERATIONS
A detailed plan to deliver and manage public safety services during
the parade, motorcade, public assembly or other event determined to be a major
event. The format for the plan will be outlined by the Village Board of Trustees
after consultation with the Fire Chief, the Monroe County Sheriff's Office
representative and the DPW Superintendent.

It shall be unlawful for any person to conduct a parade, motorcade or
public assembly in or upon any public street, sidewalk or alley in the village
or knowingly participate in any such parade, motorcade or public assembly
unless and until a permit to conduct such parade, motorcade or public assembly
has been obtained.
No permit shall be issued authorizing the conduct of a parade, motorcade
or public assembly which is proposed to be held for the sole purpose of advertising
any product, goods, wares, merchandise or event and is designed to be held
purely for private profit.
No person shall knowingly join or participate in any parade, motorcade
or public assembly conducted under permit in violation of any terms of said
permit nor knowingly join or participate in any permitted parade, motorcade
or public assembly without the consent and over the objection of the permittee
nor in any manner interfere with its progress or orderly conduct.

A. Any person who desires to conduct a parade, motorcade
or public assembly shall apply for a permit at least 45 days in advance of
the date of the proposed parade, motorcade or public assembly.
B. Said application shall be presented to the Village Clerk,
and the permit shall be issued by the Mayor if all criteria are met. If the
application is denied, the applicant may appeal to the Village Board of Trustees
which may, in its discretion, issue a permit by a majority vote of those voting.
C. The Mayor may, in his/her discretion, consider any application
for a permit to conduct a parade, motorcade or public assembly which is filed
less than 45 days prior to the date such parade, motorcade or public assembly
is to be conducted.
D. The application for a permit shall be made, in writing,
on a form approved by the Board of Trustees. In order that adequate public
safety arrangements may be made for the parade, motorcade, or public assembly,
the application shall contain the following information:
(1) The name of the applicant, the sponsoring organization,
the parade, motorcade or public assembly chairman and the address and telephone
number of each.
(2) The purpose of the parade, motorcade or public assembly,
the date when it is proposed to be conducted, the location of the assembly
area, the location of the disbanding area, the route to be traveled and the
approximate time when the parade, motorcade or public assembly will assemble,
start and terminate.
(3) A description of the individual floats, marching units,
vehicles and bands.
(4) Such other information as the Village Clerk may deem
reasonably necessary.
E. If the Village Mayor determines that a parade, motorcade
or public assembly is a "major event" as defined in this chapter, a public
safety plan of operation will be prepared for the event. Applicants may be
requested to submit additional information. The Village Board of Trustees
will approve a format for the public safety plan of operation after consultation
with relevant public officials.
Any permit for a parade, motorcade or public assembly pursuant to this
article may be summarily revoked by the issuing persons or the Board of Trustees
at any time when, by reason of disaster, public calamity, riot or other emergency,
it is determined that the safety of the public or property requires such revocation.
Notice of such action revoking a permit shall be delivered, in writing, to
the permittee by certified mail or by such other notice as the Board of Trustees
shall designate.

Violation of this article shall constitute disorderly conduct and shall be punishable as set forth in Chapter
1, General Provisions, Article
III, General Penalty.

At the time of any public parade, accident, riot, public peril or other
circumstances causing people to congregate or assemble, no person shall enter
or remain within the lines or other bounds established by the police or by
or under the direction of an authorized official for the preservation of public
safety, peace and order, unless such person is duly authorized by an officer
in charge at the scene.

Any person who shall violate any provision of this article shall, upon conviction, be subject to the penalties set forth in Chapter
1, General Provisions, Article
III, General Penalty.
