No person shall encumber or obstruct any street or public place with any article or thing whatsoever, without having first obtained permission therefor from the Council.[1]

No person shall use any portion of the sidewalk for display of wares and goods, without the permission of the Council. The Council, in its discretion, may issue a permit to a property owner to use a portion of the sidewalk for the temporary displace of wares and goods.

It shall be lawful for the appropriate committee of the Council to cause to be removed any obstruction or encroachment that shall be in and upon any of the streets or alleys of said city, and for that purpose, it may call to its aid the police of the city and other such assistance as it shall deem necessary for the removal of such obstructions or encroachment, but nothing in this Article shall give to the committee the power to cause any trees in this city to be cut down or injured nor prevent persons from occupying a portion of said streets for building purposes, upon permission obtained from the Council, as outlined heretofore. Only the Shade Tree Advisory Board may remove or trim any tree, or cause any tree to be removed or trimmed as provided in Chapter 69 of the Code of the City of Salem.
The owner or owners, tenant or tenants of lands abutting or bordering on the sidewalks or gutters of the streets and avenues of the City of Salem shall remove all ice and snow from the same within 12 hours of daylight after the same shall have formed or fallen thereon; and all grass, weeds, leaves or other impediments shall be removed from said sidewalks and gutters within three days after notice from the Chief of Police to such owner or owners, tenant or tenants to remove the same.

Any person violating this article shall, upon conviction, be subject to a fine of not less than $100 nor more than $2,000; or imprisonment in the county jail for a term not exceeding 90 days or by a period of community service not exceeding 90 days. Any person who is convicted of violating this article within one year of the date of a previous violation of the same article and who was fined for the previous violation, shall be sentenced by a court to an additional fine as a repeat offender. The additional fine imposed by a court upon a person for a repeated offense shall not be less than the minimum or exceed the maximum fine fixed for a violation of the article, but shall be calculated separately from the fine imposed for the violation of the article.

If any owner or owners, tenant or tenants shall fail to remove the snow or ice from the sidewalks and gutters so abutting or bordering on the public street and avenues of the City of Salem, within 12 hours after daylight when the same has fallen or formed; or if any such owner or owners, tenant or tenants shall neglect or fail to remove any grass, weeds, leaves or other impediments therefrom within three days after receiving notice from the Chief of Police of the City of Salem to remove the same, the Street Superintendent or other persons having charge of the streets or avenues wherein the owner or owners, tenant or tenants shall have neglected or refused to remove the impediments aforesaid may remove the same.
In the event of the removal of said impediments by the Street Superintendent or other persons having charge of the streets or avenues wherein such impediments are, then and in such case said Street Superintendent or persons removing the same shall report the costs of such removal, as nearly as may be ascertained, to the Council, and such costs shall be charged upon the book or books of the Council against the land so abutting upon or bordering on said sidewalks or gutters of said streets of the City of Salem and, with the interest thereon, shall become a lien on said lands and shall be added to and from the taxes next to be assessed and levied on said land and shall be certified by the Council to the City Treasurer or person whose duty it is to collect the taxes of the City of Salem and shall be collected by him in the same manner as the other taxes.
It shall be lawful for the Council to order the Street Superintendent or other person appointed by the resolution of said Council to cause the shade trees in and along the public streets, lanes and alleys of said city to be properly trimmed to prevent the obstruction of the streetlights, traffic signal lights or traffic control signage of the city and for the protection of the streets and roadways of the city.
