No person shall burn any substance or matter on the streets, gutters, lanes, alleys, sidewalks, driveways or yards of the Borough or any property owned by the Borough or privately owned.
A. 
Borough Council recognizes that on rare and special occasions circumstances may require some forms of open burning within Upland Borough.
B. 
A request for permission for such burning shall be forwarded to the Borough Manager/Secretary, in writing, and shall state the following:
(1) 
The name and address of the person seeking permission.
(2) 
The location of the site where the burning will take place.
(3) 
The reasons for desiring permission to burn.
(4) 
The substances or matter to be burned; and how the fire will be controlled.
C. 
Borough Council will consider all such requests. Upon Council's determination the following actions will be taken:
(1) 
If permission is not granted, the person seeking the special permission will be notified, in writing, of the same.
(2) 
If permission is granted:
(a) 
The person seeking the special permission will be notified, in writing, of the same. In addition, this notice will contain the following information:

The date and time of when the burning will be permitted.
[2] 
The site at which the burning is to be permitted.
[3] 
The way in which the burning will be carried out (i.e., container with screen top, etc.).
(b) 
A copy of this notice will be sent to the Upland Fire Company and the Borough Fire Marshal.

Any person violating any of the provisions of this chapter shall, upon conviction, be sentenced to pay a fine not exceeding $600, plus costs of prosecution for each violation.
