A certain document, (1) copy of which is on file in the office of the Manager/Secretary of the Borough of Upland, Delaware County, Pennsylvania, being marked and designated as the "International Property Maintenance Code, 2003 Edition," published by the International Code Council, and as issued and updated every three (3) years, be and is hereby adopted as the Property Maintenance Code of the Borough of Upland, Delaware County, in the State of Pennsylvania; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code are hereby referred to, adopted made a part hereof, as if fully set out in this chapter, with the additions, insertions and changes, prescribed in § 143-2 of this chapter.
The following sections are hereby revised as follows:
A. 
In Section 101.1. insert: "the Borough of Upland, Delaware County, Pennsylvania."
B. 
In Section 103.5. replace: "as indicated in the following schedule," with: "set from time to time by resolution of the Borough Council, and will be located in the office of The Borough Manager/Secretary."
C. 
In Section 304.14. Insect screens, insert: “May 1" and "November 1."
D. 
In Section 602.3. Heat supply, insert: "October 15 and "April 15."
E. 
In Section 602.4. Nonresidential structures, insert: October 15 and April 15.
F. 
Section 111.2. Membership of the Board, shall be amended as follows: "For the purpose of this chapter, the word "Board," wherever it may appear herein, will be defined as meaning the full Council of the Borough of Upland.
G. 
Sections 111.2.1. through 121.2.6. are hereby deleted.
H. 
In Section 111.5. Postponed hearing, change the words "When the full board" to the words "When any four Council members."
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
If any section, subsection, sentence, clause or phrase of this chapter is, for any reason, held to be unconstitutional, such decisions shall not affect the validity of the remaining portions of this chapter. The Upland Borough Council hereby declares that it would have passed this chapter, and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 143.3 of this chapter; nor shall any just right or remedy of any character be lost, impaired or affected by this chapter.
The Borough Manager/Secretary shall certify to the adoption of this chapter and cause the same to be published as required by law; and this chapter shall take full force and effect immediately upon the date and time of final passage and approval by the Upland Borough Council.
