[Adopted 5-28-1974 by Ord. No. 628 (Ch. 80 of the 1966 Code)]
Pursuant to N.J.S.A. 43:12-28.1, the Borough
of Emerson shall hereafter pay a pension to the widow and/or minor
children of any volunteer firefighter or first-aid or rescue squad
worker who has died or shall have died as a result of injuries sustained
in the course of the performance of duty as a member of the volunteer
fire company or first-aid or rescue squad.

Such widows and/or minor children shall be eligible
to receive benefits as described under Section 2 of P.L. 1957, c.
168 (N.J.S.A. 43:12-28.2).
Such pension shall be paid to the widow during
her widowhood or to the minor child or children of such firefighter,
or first-aid or rescue squad worker if he leaves no widow surviving
him, or to such minor child or children after the death of such widow.
Said moneys as set forth in §
69-2 shall be provided for by the Borough in its budget and shall be paid in the same manner as other Borough employees are paid.
The initial payment of such pension shall be
made on the first of the month following the death of such firefighter,
or first-aid or rescue squad worker.
As used in this chapter, the following terms
shall have the meanings indicated:
FIRST-AID or RESCUE SQUAD
Any duly incorporated first-aid and emergency or volunteer
ambulance or rescue squad association providing public first-aid,
ambulance or rescue services within the Borough.

Pursuant to N.J.S.A. 43:15C-2, the following
positions are deemed to be eligible for and shall participate in the
Defined Contribution Retirement Program, unless otherwise permitted
to participate in the Public Employees' Retirement System ("PERS")
in accordance with the terms of P.L. 2007, c. 92 and/or Section A and B of Local Finance Notice 2008-10,
or as may be prohibited from such participation owing to the fact
that they are employed pursuant to a professional services agreement:
F. Municipal Public Defender;
L. Department of Municipal Services Superintendent and
Department of Parks, Playgrounds and Recreation Superintendent.

Individuals serving in the following positions
are exempt from Defined Contribution Retirement Program membership,
pursuant to N.J.S.A. 43:15C-2:
A. Certified Health Officer;

D. Construction Code Official;
G. Registered Borough Clerk;
H. Licensed Uniform Subcode Inspector.
This article shall be implemented, construed
and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A.
43:15C-1 et seq.), as amended from time to time, and any regulations
or guidance documents from the Local Finance Board or the Division
of Pensions and Benefits.
