It shall be a punishable offense under this
article for any person in control and custody of a dog and/or walking
said dog to allow said dog to defecate on any school ground, public
park, public street, sidewalk or right-of-way, public grounds or any
private property within the Town, other than property owned or controlled
by the owner or person having control and custody of said dog, unless
said person immediately removes all feces so deposited by said dog
from such property and thence to property owned or controlled by said
person, to a Town-provided repository as they may from time to time
exist, or in an otherwise appropriate and sanitary manner.
Any person found to be in violation hereof will
be fined the sum of $25. The Selectmen of the Town are herewith authorized
to adjust the fine from time to time as they may deem appropriate.
The provisions of this article shall not apply
to any blind person in the company of a guide dog.
If a person found to be in violation shall be
a minor at the time of an offense, then the parent or guardian shall
be responsible for payment of the fine.
Nothing in this article shall be construed as
authorization of any kind for any person to make any trespass or unauthorized
entry on any private property within the Town.
