As used in this chapter, the following terms shall have the meanings indicated:
SKATEBOARD
A narrow board, constructed of wood, plastic, fiberglass or other substance, mounted on roller-skate-type wheels, designed to be ridden by a person or persons, and which has no steering device or mechanism to steer or control the direction thereof while being used or ridden, even though the direction may be controlled to some degree by shifting the feet or weight of the rider during such use.
The riding or use of skateboards within the right-of-way of West Main Street or upon the sidewalks abutting or adjacent thereto or upon any Village-owned parking lot is hereby prohibited. The area of West Main Street within which this prohibition shall apply is further defined as beginning at the center-line intersection of West Main Street and New York State Route 14 and extending westerly therefrom to the center-line intersection of West Main Street and Genesee Street.
A. 
Violation of this chapter shall be punished by the imposition of a fine in an amount not to exceed $250 or an appropriate term of community service and, in addition thereto, shall be subject to immediate seizure and forfeiture of the instrumentality (skateboard) used by the alleged violator. No jail term shall be imposable hereunder.
B. 
Following a hearing conducted by the Village Board of Trustees, upon written application of the owner of the seized property (skateboard), the Board may, in the interests of justice and for good cause shown, return the seized property (skateboard).
C. 
In the event of a final disposition of the charges in favor of the alleged violator, said seized property (skateboard) shall likewise be returned to its owner.
