The following standard codes, as last amended
or supplemented, are hereby adopted by reference for the Borough of
East Stroudsburg:
A. The BOCA National Building Code/1999, Fourteenth Edition,
as published by the Building Officials and Code Administrators International,
Inc.
B. The National Electrical Code, 1999 Edition, as published
by the National Fire Protection Association, Inc.
C. The BOCA National Fire Prevention Code/1999, Eleventh
Edition, as published by the Building Officials and Code Administrators
International, Inc.
D. The International Property Maintenance Code/1998,
as published by the International Code Council, Inc.
E. The International Plumbing Code/1997, as published
by the International Code Council, Inc.
F. The International One- and Two-Family Dwelling Code,
1998 Edition, as published by the International Code Council, Inc.
G. The International Mechanical Code/1998, as published
by the International Code Council, Inc.
H. Act 222, as enacted by the Commonwealth of Pennsylvania
on December 15, 1980, known and cited as the "Building Energy Conservation
Act," is hereby adopted in its entirety by reference thereto.
All references within said act referring to a "Board on Variances"
shall refer to the Code Hearing Board, presently constituted by the
Borough of East Stroudsburg.

A. The following sections of BOCA National Building Code/1999,
Fourteenth Edition, herein adopted, are hereby amended:
(1) Modified.
(a)
Section 121.0 Means of Appeal. Shall be in accordance with Chapter
73, Article
V.
(b)
The intent of this modification is to require
a fire suppression system in accordance with Sections 906.2.1 or 906.2.2
in all dwelling units other than one and two family dwellings.

Section 310.4 Use Group R-2 structures: This
use group shall include all multiple-family dwellings having more
than two dwelling units, and shall also include all boardinghouses
and similar buildings arranged for shelter and sleeping accommodations
in which the occupants are primarily not transient in nature. A residential
care facility shall be classified as Use Group R-2 or R-3.

Section 310.5 Use Group R-3 structures: This
use group shall include all buildings arranged for occupancy as one-
or two-family dwellings units.

Section 904.9 Use Group R-2: An automatic fire
suppression system shall be provided throughout all buildings with
an occupancy in Use Group R-2, other than residential care facilities,
in accordance with Section 906.2.1 or 906.2.2.
B. The following sections of the National Electrical
Code, 1999 Edition, herein adopted, are hereby amended or deleted
as follows: There are no deletions, amendments or additions in the
National Electrical Code herein adopted. However, the following provisions
pertaining to inspections of electrical work are in effect:
(1) Inspections for electrical work.
(a)
In cases where proposed electrical work is for
an existing 200-ampere service, the Code Enforcement Officer is authorized
to inspect additional electrical work for up to four new circuits
and/or fixtures to existing circuits, in accordance with the National
Electrical Code (most recently adopted edition).
(b)
The person or firm doing the electrical work
shall notify the Code Enforcement Officer upon completion of rough
wiring and shall not proceed further until the Code Enforcement Officer
approves the rough wiring.
(c)
The person or firm doing such electrical work
shall notify the Code Enforcement Officer upon completion of electrical
work, at which time the Code Enforcement Officer shall conduct a final
inspection.
(2) Inspections for electrical work in single, two-family,
multifamily, commercial or industrial structures.
(a)
The Code Enforcement Officer shall require that all applicants for permits for electrical work, except in those cases set forth under Subsection
B(1) above, shall furnish proof that an application for inspection of the proposed electrical wiring or electrical apparatus has been made to an organization, hereinafter referred to as the "approved electrical organization," that is licensed to perform such inspections in the Commonwealth of Pennsylvania; the payment of all inspection fees and charges of such organization shall be borne by the applicant.
(b)
Electrical certificate of approval.

All applicants shall, before occupancy of the building, structure or premises, obtain an electrical certificate of approval from an approved third-party inspection service, except on those cases exempt under Subsection
B(1).

Whenever the inspection of the approved electrical
organization shows that the provisions of the National Electrical
Code have not been complied with, said organization shall so inform
the Code Enforcement Officer. The Code Enforcement Officer shall then
notify the applicant of the steps which must be taken to achieve compliance
with the National Electrical Code before an electrical certificate
of approval will be issued. Failure to secure an electrical certificate
of approval shall be sufficient reason for notification of the electrical
utility company to disconnect or refuse to connect electrical power
to the premises, or the Borough not to issue an occupancy permit.
C. The following sections of BOCA National Fire Prevention
Code/1999, Eleventh Edition, herein adopted, are hereby amended or
modified as follows:

Section F-112.3 Penalty for violations. Shall be in accordance with §
73-12.
(b)
Section F-113.0 Means of Appeal. Shall be in accordance with Chapter
73, Article
V.
D. The following section of the International Property
Maintenance Code/1998, herein adopted, is hereby amended to read as
follows:

There shall be appointed by the Council of the
municipality a Health Officer who shall enforce the health provisions
of Part 3.
