Sketch, preliminary and final plans for all proposed
subdivisions of land lying within the Borough limits shall be filed
with the Planning Commission for approval.
Subdivision and land development plans and supporting
data submitted to the Planning Commission will be considered at the
Commission's next regularly scheduled meeting, provided that they
are received at least 15 calendar days before said meeting.

The initial plan filed with the Commission for review shall be considered the official preliminary plan. However, the Commission may proceed to final action at the first consideration of a plan for a minor subdivision containing no new streets, if the plan and supporting data comply with all of the requirements for final plans contained in § 140-9.
The subdivider may prepare a sketch plan for informal
discussion with the Commission before submitting the official preliminary
plan for review. This plan shall be for the purpose of establishing
in advance, if possible, the extent to which the proposed subdivision
conforms to the Comprehensive Plan and design standards of this chapter.
Eight copies of the sketch or preliminary plan shall
be submitted to the Zoning Officer by the developer. The plans must
be submitted 15 days before the Planning Commission's regularly scheduled
meeting with a completed land development or subdivision application.
It is the applicant's responsibility to file copies with the Monroe
County Planning Commission.

Fees to defray the cost of the subdivision and land
development review shall be paid to the order of the Borough of East
Stroudsburg according to the following fee schedule:

The Borough realizes that it will incur professional
costs in addition to the administrative costs associated with the
approval of a subdivision or land development plan and has established
the following fees to be held on account:
When sketch plans require an engineering review,
a fee sufficient to cover the Borough's cost shall be deposited. This
fee shall be to cover the engineering review and shall be deposited
with the Borough prior to the release of the Borough Engineer's review.
Within 30 days after the meeting at which the preliminary
subdivision plan is reviewed, the Commission shall notify the subdivider
of the changes and modifications, if any, which must be incorporated
on the final plan before it shall be approved.
Approval of the preliminary plan, subject to conditions,
revisions and modifications as stipulated by the Commission, shall
constitute conditional Commission approval of the subdivision as to
the character and intensity of the development and the general layout
and appropriate dimensions of streets, lots and other proposed features.
Within 14 days of the date the preliminary plan was
presented to the Planning Commission, the Commission shall transmit
to the Borough Council its recommendations, in writing, regarding
what modifications or changes the Commission recommends.
A final plan with supporting data shall be submitted
to the Commission for final approval within one year after Commission
action on the preliminary plan, provided that an extension of time
may be granted by the Commission upon written request. Otherwise,
the plan submitted shall be considered as a new preliminary plan.
The final plan shall conform in all important respects
to the preliminary plan as previously reviewed by the Commission and
shall incorporate all modifications and revisions specified by the
Commission in its conditional approval of the preliminary plan. Otherwise,
the plan shall be considered as a revised preliminary plan.
The Commission may permit submission of the final
plan in sections, each covering a portion of the entire proposed subdivision
as shown on the preliminary plan.
The final plan and supporting data shall comply with the provisions of Article VI and §§ 140-26 through 140-28 of this chapter. Failure to do so shall be cause for tabling the plan.
Eight copies of the final plan with supporting data
shall be submitted to the Zoning Officer 10 days before the Planning
Commission's regularly scheduled meeting.
Within 14 days after the meeting at which the final
plan is reviewed, the Commission shall notify the Council, in writing,
of its approval or disapproval. Reasons for disapproval shall be explicitly
stated. A copy of said notification to the Council shall be sent to
the subdivider.
Upon receipt of the final plan from the Commission,
the Council may arrange for a public hearing after giving proper public
notice or may take final action on the plan at a regularly scheduled
meeting. Disapproval of the final plan by the Council shall be by
a motion, giving the reasons therefor. Failure of the Council to take
final action on the plan within 30 days of receipt from the Commission
shall constitute Council approval of the plan.
When both the Planning Commission and the Council
have approved the final plan, the Borough Secretary and the Commission
Secretary shall endorse three copies of the final plan to that effect.
One copy of the endorsed final plan shall be kept in the Commission
files and the other returned to the subdivider.
The subdivider shall record the final plan in the
office of the Recorder of Deeds of Monroe County within 30 days after
the date of approval by the Borough Council. The copy of the final
plan filed for recording shall be a clear and legible white print
on linen, bearing the approval of the Borough Planning Commission
and the Borough Council.
