Minimum improvements and construction standards
required of all subdivisions shall be as set forth in this section.
Where not set forth, they shall be according to the prevailing standards
as established by the Commission upon advice of the Commission Engineer.
Alternate improvement standards may be permitted if the Commission
deems them equal or superior in performance characteristics to the
specified improvements. Additional or higher-type improvements may
be required in specific cases where the Commission believes it necessary
to create conditions essential to the health, safety, and general
welfare of the citizens of the Borough.
Storm sewers shall be installed when, in the
opinion of the Commission, it is deemed necessary to provide adequate
drainage for the subdivision and according to the requirements in
Appendix A.

Trees and landscaping shall be retained or provided
in any subdivision or land development according to the requirements
in Appendix C.

In all cases, the developer shall be responsible
for the installation of all required improvements under supervision
of the Borough Engineer and in the manner specified below.

A. No final plan shall be approved by the Borough until
provision has been made for the proper installation of required improvements
in either of the following ways:
(1) Performance bond. The developer may post with the
Borough a letter of credit, cash or bond made out to the Borough of
East Stroudsburg, Monroe County, in an amount equal to 110% of the
cost of installing the required improvements as estimated by the Borough
Engineer. In the case of a bond filed, it shall be with surety satisfactory
to the Borough. The time for completion of the improvements and installations
shall be specified and shall be satisfactory to the Borough.
(2) Construction of improvements. In lieu of posting
a bond, the developer may elect to install the required improvements
according to the standards and specifications contained in this article
and with the final plan submitted to the Borough. The developer shall
obtain a certificate from the Borough Engineer stating that all improvements
have been so installed after reimbursing the Borough for any expense
incurred from the Borough Engineer’s inspection.
B. Upon construction of required improvements to be dedicated
to the Borough, the developer shall submit a maintenance bond (or
cash or letter of credit) to guarantee maintenance and repair of such
improvements in the subdivision or land development for one year after
the construction thereof has been approved by the Borough Engineer.
The maintenance bond shall be in the amount of 15% of the cost of
installing such required improvements as estimated by the Borough
Engineer.
