A. 
A mound system of sewage disposal shall be permitted for existing buildings and new buildings where it has been determined by the Waukesha County Health Department that a conventional-type sewage disposal system in operation on such premises has failed and a new conventional-type sewage disposal system would not function on the premises or that the soil on the premises upon which new construction is proposed would not support a conventional-type sewage disposal system. A mound system of sewage disposal shall be approved by the Waukesha County Health Department before the same may be constructed.
B. 
Sewage holding tanks will be prohibited for new construction in the Village unless a variance allowing the construction thereof is granted by the Village Zoning Board of Appeals.
C. 
Holding tanks will be permitted for existing buildings where the sewage disposal system for such building has failed as determined by the Waukesha County Health Department and a new conventional-type sewage disposal system or a mound system cannot be constructed on the premises.
D. 
The provisions of § 354-2 of this chapter shall apply to applications for holding tank permits as provided in this section.

Section 66.0627, Wis. Stats., is hereby adopted by reference as if fully set forth herein. Any charge incurred by the Village in the inspection, operation or pumping out of any sewage holding tank will be charged against the property owner in accordance with the provisions of § 66.0627, Wis. Stats. Any expense incurred in the administration or enforcement of this section will also be charged against the property owner.
Except as otherwise provided, any person found to be in violation of any provision of this chapter shall be subject to a penalty as provided in § 1-4 of this Code.
