This chapter applies to all officers and employees, whether elected
or appointed, paid or unpaid, and to officers, members and employees of all
boards, commissions or agencies of this local government.
As used in this chapter, the following terms shall have the meanings
indicated:
INTEREST
A direct or indirect pecuniary or material benefit accruing to an
officer or employee as the result of a contract with the village. For the
purposes of this chapter, a municipal officer or employee shall be deemed
to have an interest in the contract of:
A. His or her spouse, minor children and dependents, except
a contract of employment with the village.
B. A firm, partnership or association of which the officer
or employee is a member or employee.
C. A corporation of which such officer or employee is an
officer, director or employee.
D. A corporation, any stock of which is owned or controlled
directly or indirectly by such officer or employee.
No officer, employee or member of any board, commission or agency shall
knowingly:
A. Engage in any business or transaction or have any financial
or personal interest, direct or indirect, which is incompatible with the proper
discharge of his or her duties or would tend to impair his or her independence
of judgment or action in the performance of his or her official duties or
discharge of official responsibilities.
B. Engage in or accept private employment or render services
for private interest when such employment or service is incompatible with
the proper discharge of his or her official duties or would tend to impair
his or her independence of judgment or action in the performance of his or
her official duties.
C. Disclose confidential information concerning the property,
government or affairs of the governmental body by which he or she is employed
without proper legal authorization or use such information to advance the
financial or other private interest of himself, herself or others.
D. Solicit any gift having a value of $75 or more, whether
in the form of service, loan, thing or promise, from any person, firm or corporation
who or which to his or her knowledge is interested, directly or indirectly,
in any manner whatsoever in business dealings with the governmental body by
which he or she is employed; provided, however, that any officer or employee
who is a candidate for public office may accept campaign contributions and
services in connection with any such campaign.
E. Vote or otherwise participate in the negotiations or
in the making of any contract with any business or entity in which he or she
has a financial interest.
Any officer or employee who has, will have or later acquires an interest
in any actual or proposed contract with the village shall publicly disclose
the nature and extent of such interest, in writing, to the Board of Trustees
as soon as he or she has knowledge of such actual or prospective interest.
Such written disclosure shall be made a part of and set forth in the official
record of the proceedings of such Board. Any member of the Board of Trustees
who has a private interest in any matter pending before the Board of Trustees
shall disclose such private interest on the records of the Board and shall
disqualify himself or herself from participating in any decision or vote relating
thereto.
No officer, employee or member of any board, commission or agency to
which this Code of Ethics applies shall use property owned by the village
for personal benefit, convenience or profit except in accordance with policies
promulgated by the Board of Trustees.
Failure to distribute copies of this Code of Ethics or failure of any
officer or employee to receive such copy shall have no effect on the duty
of compliance with such code and shall have no effect on the enforcement of
provisions thereof.
In addition to any penalty contained in any other provision of law,
any person who shall knowingly and intentionally violate any of the provisions
of this code may be fined, suspended or removed from office or employment,
as the case may be, in the manner provided by law.
