The Village of Phoenix shall contain, on and after the effective date
of this chapter, in addition to the territory theretofore contained within
its boundaries, the following described territory:
A. All that tract or parcel of land situate in the Town
of Schroeppel, County of Oswego and State of New York, being part of subdivision
Lot No. 2, being part of lands conveyed by Anna L. Johnson to George M. and
Nola L. Waters by deed dated May 22, 1946, and recorded in Oswego County Clerk's
Office November 15, 1946, in Book 434 of Deeds at page 227 and described as
Lot Nos. 2, 3 and 4 of the Susan C. Waters Resubdivision Map as filed in Oswego
County Clerk's Office August 7, 2003, as Plat 19-Line 20 (Instrument
Number R-2003-011082) and being more particularly described as follows: beginning
at a point in the northeasterly boundary of Oswego County Route No. 57, said
point being the intersection of the present division line between said Town
of Schroeppel on the northwest and the Village of Phoenix on the southeast;
running thence northeasterly along said division line a distance of about
987.3 feet to the westerly boundary of the New York Central right-of-way (Oswego
Branch); thence southerly along said westerly boundary of the New York Central,
a distance of about 53.5 feet to the northwesterly boundary of Oswego County
Route No. 57A; thence southwesterly along said northwesterly boundary of said
Oswego County Route No. 57A, a distance of about 709.1 feet to the northeasterly
corner of Lot No. 1 of said Susan C. Waters Resubdivision; thence southwesterly
along the southerly boundary of said Lot No. 1, a distance of about 214.3
feet to the easterly corner of lands conveyed by George M. and Lola L. Waters
to Harry and Mildred G. Allen by deed recorded in the Oswego County Clerk's
Office in Book 468 of Deeds at page 369; thence along the northeasterly and
northwesterly boundaries of said lands conveyed to Allen, distances of about
100 feet and 250 feet, respectively, to the aforementioned northeasterly boundary
of Oswego County Route No. 57; thence northwesterly along said northeasterly
boundary of Oswego County Route No. 57, a distance of about 150 feet to the
point of beginning, containing about 5.13 acres of land, more or less, subject
to any easements or restrictions of record.
The territory described in §
74-1 of this chapter is hereby annexed to the Village of Phoenix pursuant to the provisions of § 714 of the General Municipal Law.
