The International Property Maintenance Code, 2018 Edition, is
hereby adopted as the Property Maintenance Code, for application,
use, and enforcement within the Township of Lawrence.
The enforcement provisions for the International Property Maintenance
Code, 2018 Edition, are hereby adopted as the enforcement provisions
for the Township of Lawrence.
Any and all prior ordinances of the Township of Lawrence adopting
the International Property Maintenance Code or in conflict with this
chapter are hereby repealed.
If any section, subsection, sentence, clause, or phrase of this
chapter is, for any reason, held to be unconstitutional, such decision
shall not affect the validity of the remaining portions of this chapter.
This chapter and the rules, regulations, provisions, requirements,
orders, and matters established and adopted hereby are deemed to be
necessary in order to assure the public safety and well-being of the
citizens of the Township of Lawrence and shall take effect and be
in full force and effect immediately from and after the date and time
of the final passage and adoption.
The following insertions and changes to the International Property
Maintenance Code, 2018 Edition, shall be applied to this chapter:
A. Section 101.1. Insert: Lawrence Township.
B. Section 103.5. Insert: According to Lawrence Township Resolution
adopted May 6, 2003, that shall be amended by Resolution from time
to time.
C. Section 106.4 Violation penalties is hereby amended to read as follows:
Any person who shall violate a provision of this code, or fail to
comply therewith, or with any of the requirements thereof, shall be
prosecuted within the limits provided by state or local laws. Any
person who shall violate such provisions shall be guilty of a summary
offense and subject to a fine of not less than $50 and not more than
$1,000, or imprisonment for a term not to exceed 30 days, or both,
and shall be ordered to correct the violation or make restitution
for the correction of the violation thereof, at the discretion of
the Court. Each day that a violation continues shall be deemed a separate
offense.
D. Section 112.4. Insert: $50 to $1,000.
E. Section 302.4 shall read as follows:
302.4 Weeds. All premises and exterior property
shall be maintained free from weeds or plant growth in excess of 10
inches. All noxious weeds shall be prohibited. Weeds shall be defined
as all grasses, annual plants, and vegetation, other than trees or
shrubs; provided, however, this term shall not include cultivated
flowers and gardens.
Upon failure of the owner or agent having charge of a property
to cut and destroy weeds after service of a notice of violation, they
shall be subject to prosecution in accordance with Section 106.3 and
as prescribed by the authority having jurisdiction. Upon failure to
comply with the notice of violation, any duly authorized employee
of the jurisdiction or contractor hired by the jurisdiction shall
be authorized to enter upon the property in violation and cut and
destroy the weeds growing thereon, and the costs of such removal shall
be paid by the owner or agent responsible for the property.
F. Section 304.14. Insert: April 1 to December 1.
G. Section 602.3. Insert: October 1 to April 1.
H. Section 602.4. Insert: October 1 to April 1.
This chapter shall take effect on the 1st day of November, 2022.
