[Amended 3-19-1963; 1-8-1974 by Ord. No. 34-73]
The owner or owners, occupant or agent of every lot of land
fronting on any street, highway or public place within the Borough
of Washington shall, within the first 12 hours of daylight after every
fall of snow, remove or cause the same to be removed entirely from
off that portion of the sidewalk which has been paved in front of
such lot of land. No person or persons shall, in the shoveling of
said walks or their property, throw any of the snow or ice in the
streets of the Borough of Washington beyond the plow line.
[Amended 1-8-1974 by Ord. No. 34-73]
Whenever any sidewalk or any part thereof in front of any lot
of land on any street or highway or public place within the Borough
shall become covered or partly covered with ice, the owner or owners,
occupant or agent of the said premises shall cause such sidewalk to
be made safe and convenient for pedestrians by removing the ice therefrom
or by covering the same with sand or ashes within the first five hours
of daylight after the formation of such ice.
In case such owner or owners, occupant or agent of any land
fronting on any street or highway or public place in said Borough
shall fail to remove such snow from the sidewalk or from the pathway,
as the case may be, and remove the ice or cover it with sand or ashes,
within the time hereinbefore required, it shall be lawful for the
Street Supervisor or other officer having charge of the streets of
the Borough to remove entirely such snow or ice from off the paved
portion of the sidewalk in front of said lot or lots of land or, where
a paved walk has not been laid, to form a pathway in front thereof.
The cost and expense paid and incurred by the Street Supervisor or other officer for removing such snow or ice from any sidewalk and for forming the pathway, where required, shall be ascertained by the Council and certified to the Assessor of the Borough, and such expense shall be added to and form a part of the tax or taxes next to be levied and assessed on the lot or lots of land in front of which such sidewalk is, from which snow or ice has been removed or the pathway formed, to be collected according to law, and shall be a lien upon said lands until paid; and this liability of the owner or owners of the said land shall be in addition to his or her liability to the fine imposed by §
75-18 of this article.
[Added 1-8-1974 by Ord. No. 34-73]
Any person who violates any of the provisions of this article
shall, upon conviction thereof, be punishable by a fine of not more
than $500 or by imprisonment in the county jail for a period of not
more than 90 days, or by both such fine and imprisonment.
