The owner(s), occupant(s) or tenant(s) of every parcel of land abutting upon any street or highway within the Borough of Washington shall be responsible for the removal of grass, weeds and other impediments from abutting sidewalks and gutters. Owner(s), occupant(s) or tenant(s) of every parcel of land within the Borough of Washington shall, within three days after notice, remove or cause to be removed all grass, weeds or other impediments from the abutting sidewalks and gutters on the portion of any street or highway abutting upon such parcel of land. No person(s) in the process of removing grass, weeds or other impediments from any sidewalk or gutter shall throw and leave any grass, weeds or other debris in the streets or highways within the Borough of Washington. All weeds, grass and debris must be disposed of properly in accordance with the provisions of Chapter
47 of the Code of the Borough of Washington.
In addition to the penalty provisions contained in this article,
if any owner(s), occupant(s) or tenant(s) of any parcel of land abutting
upon any street or highway fails to remove such grass, weeds or other
impediments from the sidewalks or gutters, after notice in accordance
with law, the Borough may cause said grass, weeds or other impediment
to be removed from the sidewalk and gutter on the portion of any street
or highway abutting upon such parcel of land.
The cost and expense paid and incurred by the Borough for removing
such grass, weeds or other impediments from any sidewalk or gutter
shall be ascertained by the Borough Manager and presented to the Mayor
and Council which shall certify to the Collector of the Borough such
expense, who shall cause such expenses to be added to and form a part
of the tax or taxes next to be levied and assessed to the lot or lots
of land abutting said sidewalk or gutter from which grass, weeds or
other impediments were removed at Borough expense, to be collected
according to the law and shall be a lien and tax upon said lands until
paid and this liability of the owner(s) of said land shall be paid
in addition to his or her liability to the penalty provisions contained
in this article.
Any person(s) who violates any of the provisions of this article
shall, upon conviction thereof, be punished by a fine of not more
than $500 or by imprisonment in the county jail for a period of not
more than 90 days, or both such fine and imprisonment.
