Pursuant to authority granted to municipalities by the Commonwealth of Pennsylvania by the Act known and cited as the "Pennsylvania Municipalities Planning Code," approved July 31, 1968, effective January 1, 1969, P.L. 805, Art. I, Section 101 et seq., as amended or revised (53 P.S. § 10101 et seq.), a Borough Planning Commission composed of three members, appointed for terms of four years, in the manner provided by the Pennsylvania Municipalities Planning Code, as amended or revised, is hereby created and established in and for the Borough of Dover, York County, Pennsylvania, provided that the persons constituting the Borough Planning Commission now functioning in the Borough of Dover shall constitute the Planning Commission hereby created, and nothing in this chapter shall affect the tenure of said present Borough Planning Commission, but all vacancies hereafter existing or occurring in said Planning Commission, regardless of the cause thereof, shall be filled in accordance with the provisions of the law governing planning commissions in boroughs or municipalities at the time of the occurrence of said vacancy.
The Borough Planning Commission shall, in the Borough of Dover, perform all the duties delegated to it by the Borough Council and shall exercise the powers vested in planning commissions by the Pennsylvania Municipalities Planning Code, as amended or revised.[1]
