It shall be unlawful for any plumbing contractor to carry on or work at the business of plumbing or house or building drainage in Borough of Dover until a license to engage in or work at said business shall have been granted said persons by the Plumbing Inspector or Borough Engineer of Dover; nor until they have registered as such in the office of the Borough Secretary as hereinafter provided.
A. 
All plumbing contractors, with three years or more practical experience, engaged or engaging in the business or work of plumbing, house and building drainage in said borough shall apply, in writing, to the Borough Secretary for such license; and if, after proper qualification as required by the Plumbing Inspector and/or Borough Engineer, such person or persons so applying shall be found competent, the same shall be approved by the Plumbing Inspector and/or Borough Engineer of Dover, who shall thereupon issue a license to such person or persons which shall, for the period of one calendar year or fractional part thereof next ensuing the date of such qualification, entitle him or them to engage in or work at the business of plumbing, house and building drainage.
B. 
Any plumbing contractor who for a period of at least one year previous to the passage of this article has been regularly engaged in the plumbing business in the Borough of Dover, Pennsylvania, shall be deemed competent to hold a license, subject to the foregoing resolutions; and all other persons, firms or corporations desiring to do any plumbing work shall exhibit such evidence of competency as the Plumbing Inspector and/or Borough Engineer shall from time to time require.
C. 
Every plumbing contractor who shall desire to be licensed in the Borough of Dover as a first class plumber shall, before being registered, pay to the Borough Secretary of the Borough of Dover a fee of in the amount set by resolution of the Borough Council.

D. 
At the expiration of each calendar year, said license shall be null and void. A licensed first class plumber desiring to continue in or work at the business of plumbing, house and building drainage for the ensuing year shall, between the first and 31st days of December of each and every year renew the license with the Borough Secretary.[1]

Any plumbing contractor who shall fail to comply with any of the provisions of this chapter regarding the procuring of a license to engage in or work at the business of plumbing, house and building drainage shall be liable, upon conviction, for each and every day he or they shall engage in or work at said business without first having obtained said license, to a fine of not more than $600, plus costs of prosecution, and in default of payment thereof to imprisonment for not more than 30 days.

A certain document, three copies of which are on file in the office of the Secretary of the Borough of Dover, York County, Pennsylvania, being marked and designated as the "BOCA National Plumbing Code, Ninth Edition, 1993," as published by the Building Officials and Code Administrators International, Inc., is hereby adopted as the Plumbing Code of the Borough of Dover in the Commonwealth of Pennsylvania for the control of buildings and structures as herein provided. Each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions and changes, if any, prescribed below.

The following sections of the BOCA National Plumbing Code, Ninth Edition, 1993, are hereby revised as follows:
A. 
Section P-101.1 (page 1, second line): insert "Dover Borough."
B. 
Section P-113.2 (page 4, third line): insert "As adopted by resolution of Dover Borough Council."
C. 
Section P-116.4 (page 5, seventh, eighth and ninth lines): insert offense: "summary offense"; dollar amount: "$600"; time: "30 days."
D. 
Section P-117.2 (page 5, fifth and sixth lines): insert "not less than $100 nor more than $600."
E. 
Section P-304.3 (page 13, third line): insert "150 feet."
F. 
Section P-309.4 (page 14, second and third lines): insert "3 feet 6 inches."
G. 
Section P-309.5 (page 14, second and fourth lines): insert "10 inches" and "48 inches."
H. 
Chapter 4, Sections P-403.4 and P-403.5 of the BOCA National Plumbing Code, Ninth Edition, 1993, are hereby amended to remove and delete all references in those two sections to any type of metal pipe, whether it be brass, cast iron or copper. It is the intent of this amendment to prohibit the use of brass, cast iron, copper or copper alloy pipe in the water service pipe and the water distribution pipes of the borough. It is the intent of this article to allow only plastic pipe to be used as water service pipe or water distribution pipe.
