As used in this article, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Any beverage regulated by the Alcoholic Beverage Control Commission of the State of New Jersey or taxed as an alcoholic beverage under the Internal Revenue Laws of the United States, including, with limitation, beer, wine, distilled spirits of alcohol and mixed drinks containing such spirits, or combination thereof.
OPEN CONTAINER
A container in which alcoholic beverages as defined in this article are contained, or on which the seal of original packaging has been broken or a container such as a glass, mug, flask, thermos or other beverage cup or vessel containing alcoholic beverages.
PUBLIC PLACES
Any property owned by the Township of Commercial or over which the Township of Commercial or other governmental entity has a right-of-way for public places in the Township of Commercial, whether they be federal, state, county, or municipal.

It shall be unlawful, within the Township of Commercial, in any public place to possess an open container containing alcohol beverage or to consume an alcoholic beverage in a public place.

Any person violating any provision of this article shall, upon conviction, be subject to a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof.
