The Township Committee of the Township of Commercial hereby make the following declarations:
A. 
The Township Committee has received numerous complaints from residents as to the enforcement of the Code provisions by the Department of Community Affairs, and desires to provide for more efficient and appropriate enforcement and, therefore, desires to create its own enforcing agency.
B. 
The Township Committee hereby creates a Construction Code Enforcement Department headed by a Construction Code Official for Commercial Township.
C. 
Certain procedural steps are required to create this Department, including the adoption of an ordinance and notifying the Department of Community Affairs with respect thereto and the Township Committee, therefore, desires to provide for same in accordance with the New Jersey Administrative Regulations.
A. 
There is hereby established in the Township of Commercial a State Uniform Construction Code enforcement agency, to be known as the "Commercial Township Construction Enforcement Department," consisting of a Construction Code Official, as approved by the Department of Community Affairs of the State of New Jersey and hereafter adopts as part of this article the State Uniform Construction Code. The Construction Code Official shall be the chief administrator of the enforcing agency and shall be appointed by the Township Committee.
B. 
Each official position created in this Section hereby shall be filled by a person qualified for such position pursuant to P.L. 1975, c.217, as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular sub code official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c.217 and N.J.A.C. 5:23 to hold each such position.
C. 
The public shall leave the right to do business with the enforcing agency at one official location except for emergencies and unforeseen or unavoidable circumstance.
The State Uniform Construction Code has been established by the State of New Jersey, New Jersey Commissioner of Community Affairs, pursuant to New Jersey State Statutes and has an effective role in the Township of Commercial. A copy of said Code shall be on file in the Office of the Township Clerk. The Commissioner has also adopted subcodes of the State Uniform Construction Code, and Elevator Code and a Fire Protection Code which also have an effective role in the Township of Commercial. Copies of same are also on file in the Office of the Township Clerk. Said Code shall be enforced by the Commercial Township Construction Code Enforcement Department. The Construction Code Official, as a Chief Administrator of the enforcing agency, shall be responsible for the enforcement of the Codes.
Fees shall be established by resolution of the Township Committee of the Township of Commercial, County of Cumberland, in accordance with the guidelines established by the State of New Jersey.
