The use or maintenance of any waste disposal
area within the Municipality other than those areas, if any, officially
established by New Jersey Department of Environmental Protection or
officially designated by the Municipality shall constitute a detriment
to the public health and a nuisance, and a violation of this article.
No person, firm, or corporation, whether acting
as contractor, agent, employee, collector or owners, shall dump, deposit
or dispose of any garbage, animal matter, refuse, rubbish debris,
salvage or waste material in or upon any lands anywhere within the
Municipality other than the designated and permitted areas. Nothing
in this section shall be construed to hinder, impede or prevent the
ordinary and normal activities of a farm operation.
The throwing or discarding of any garbage, trash,
refuse, wastepaper, or any other material in a public or private place,
or on the roadway, shall be considered littering. Each act of littering
shall be considered a separate violation of this article.
Litter receptacles, which shall be regularly
serviced by the municipality if located in a public place and regularly
serviced by the property owner if located on private property shall
be required at the following locations: sidewalks used by pedestrians
in active retail commercial-zoned areas, such that at a minimum there
shall not be a single linear quarter-mile without a receptacle; buildings
held for use by the public, including schools, government buildings,
and railroad and bus stations; parks; drive-in restaurants; all street
vendor locations; self-service refreshment areas; construction sites;
gasoline service station islands, shopping centers; parking lots;
campgrounds and trailer parks; marinas, boat moorage and fueling stations;
boat launching areas; public piers operated for public use; beaches
and bathing areas; and at special events to which the public is invited,
including sporting events, parades, carnivals, circuses, and festivals.
The proprietors of these places or the sponsors of these events shall
be responsible for providing and servicing the receptacles such that
adequate containerization is available.
The storage in areas zoned residential of any
bulky household items such as appliances, furniture or mattresses,
except in a fully enclosed structure or during days designated for
the collection of bulky items, shall be prohibited.
The storage of tires in areas zoned residential
except in a fully enclosed structure or on days designated for the
collection of tires shall be prohibited.
The keeping of inoperable or unregistered vehicles
on streets, vacant lots, and residential lawns shall be prohibited,
except for one unregistered vehicle per lot.
Any vehicles carrying loads capable of dropping,
sifting leaking or otherwise escaping shall be covered so that any
materials contained therein cannot escape.
The accumulation of debris on or around construction
sites, or its storage in such a manner that it is likely to be removed
by natural forces onto adjacent property shall be prohibited.
Uncovered or overflowing commercial, industrial
or residential waste disposal bins other than inside the structure
shall be prohibited.
Every owner, lessee, tenant, occupant or person
in charge of any building or structure shall keep and cause to be
kept the sidewalk and curb abutting said building or structure free
from obstruction and nuisances of every kind, and shall keep said
sidewalks, areaways, backyards, courts and alleys free from litter
and other offensive materials.
Any person sweeping into or depositing in any
gutter, street, catch basin, or other public place any accumulation
of litter from any public or private sidewalk or driveway shall be
in violation of this article. Every person who owns or occupies property
shall keep the sidewalks in front of his or her premises free of litter
and all sweepings shall be collected and properly containerized for
disposal.

Any person, firm or corporation who shall violate
any provision of this article shall, upon conviction, be subject to
a fine not exceeding $2,000, imprisonment for a term not exceeding
90 days or a period of community service not exceeding 90 days, or
any combination thereof; plus the cost of cleanup. Each day upon which
a violation of this article shall continue to exist shall be deemed
a separate offense.
