Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York and which is not enumerated in the schedule in §
264-64 below shall, for a first conviction thereof, be punished by a fine of not more than $100 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $200 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $300 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.

B. The fine for violations of this chapter shall be set forth in §
264-64A; however, each such registered owner may, within five business days, exclusive of the date on which the ticket was issued, pay to the Village Court the "five-business-day fine" as set forth in §
264-64A. Failure to pay the fine or contest the ticket within 30 days of the date of issuance will be deemed an admission of liability, and a penalty of $15 will be added to the assessed fine indicated above. If an information is filed with the court, an arrest warrant for the arrest of the registered owner of the vehicle may issue. This chapter shall take effect immediately and shall apply to violations which occur on or after the effective date hereof.

C. Fines for any of the offenses listed above which are
also covered by the New York State Vehicle and Traffic Law shall in
no event be less than those mandated by state law. In the event that
state law is amended such that the fines described in such law are
different from those set forth herein, the law providing for the largest
possible fine shall prevail in all cases.
Any police or peace officer shall have power
and authority whenever deemed advisable during a fire or at the time
of an accident or special emergency and for such period of time only
as is necessitated thereby for the public safety or convenience to
temporarily close any street, avenue or any public place in the Village
to vehicular traffic or to vehicles of certain description or to divert
the traffic therefrom or to divert or break the course of pedestrian
traffic. Any person interfering with the execution of the foregoing
police officers or peace officers shall be a disorderly person.
No person acting as engineer, conductor or other
person in the employ of a railroad company or corporation shall cause
or permit any locomotive, car or cars to stop and stand on or across
any public street or avenue in the Village so as to obstruct travel
thereon for a longer period than five minutes at a time, except when
necessarily loading or unloading the same with passengers or freight.
All existing signs, signals, markings and devices
posted pursuant to order of the Board of Trustees shall be deemed
to have been posted under authority granted by this chapter and the
Vehicle and Traffic Law, and the posting thereof is hereby ratified
and confirmed.
No person shall willfully or otherwise deface,
injure, move, obstruct or interfere with any legal traffic sign or
signal or any other restrictive or directional sign temporarily or
otherwise placed under or by direction of any of the municipal departments
of the Village.
The Board of Trustees shall, from time to time,
determine those streets, intersections and areas where traffic shall
be controlled by signals exhibiting different colored lights successively
or with arrows. The provisions of § 1111 of the Vehicle
and Traffic Law shall be applicable whenever traffic is controlled
by such traffic control signals.
The Board of Trustees shall from time to time
determine those streets and intersections at which traffic shall be
controlled by means of illuminated flashing red or yellow signals.
The provisions of § 1113 of the Vehicle and Traffic Law
shall be applicable whenever traffic is controlled by means of such
flashing signals.
The erection of stop signs at all four corners
of through streets intersecting with each other shall be authorized,
with the right-of-way as provided by the Vehicle and Traffic Law.
All emergency vehicles shall have the right-of-way
through all streets and avenues in the Village. On the approach of
an emergency vehicle, as evidenced by suitable warning or signal indicating
the route of such emergency vehicle, every driver or person in control
of another vehicle shall immediately drive such vehicle as near as
practicable to the right-hand curb or side of each avenue or street
and parallel thereto and bring it to a standstill and there remain
until such emergency vehicle shall have passed.
Whenever any hose of the Fire Department of
the Village shall be placed in or upon any street or avenue or across
any railroad tracks in the Village in response to any alarm of fire
or for the purpose of putting out a fire, it shall be unlawful for
any person to drive or propel or cause to be driven or propelled on
or across such hose any motor vehicle, truck, wagon, locomotive, car
or other vehicle.
It shall be unlawful for any person to stop
to make repairs to or upon any vehicle in or on any public street
or roadway in the Village except in an emergency.
