Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time, as may be in current use in the Borough.
9-3.1
Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
9-3.2
Parking prohibited during state of emergency.

a.
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b.
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before gaining possession of the vehicle.
c.
The effectiveness of this subsection is contingent upon signs being erected as required by law.
9-3.3
Parking prohibited at all times on certain streets. No person shall park a vehicle at any time upon any of the streets or parts of streets described in Schedule I attached to and made a part of this chapter.

9-3.4
Parking prohibited during certain hours on certain streets. No person shall park a vehicle between the hours specified upon any of the streets or parts of streets described in Schedule II attached to and made a part of this chapter.

9-3.5
Parking time limited on certain streets. No person shall park a vehicle for longer than the time limit designated at any time between the hours limited, upon any of the streets or parts of streets described in Schedule III attached to and made a part of this chapter.

9-3.5A
Parking time limited at Bradley Beach Grammar School.

a.
It is the intention of the Mayor and Council to provide for the safety of its citizens and children and to establish an area along Fifth Avenue and Hammond Avenue adjacent to the Borough Grammar School in the Borough of Bradley Beach for the loading and unloading of children during school hours.
b.
Except as otherwise provided at all times and on all days when school is in session, it shall be unlawful to park on the north side of Fifth Avenue or east side of Hammond Avenue along the side of the school property where posted from 7:30 a.m. to 4:00 p.m.
c.
On the north side of Fifth Avenue alongside the school, it shall be lawful to stand or park a vehicle for the sole purpose of loading and unloading of children going to and coming from the school. In no event shall a vehicle remain in the loading and unloading zone for a period of longer than three minutes.

Rules and regulations.

a.
Violations. It shall be unlawful and a violation of this chapter for any person:
1.
To cause, allow, permit or suffer any vehicle of any kind or nature, registered in the name of, or operated by such person, or placed or driven thereon by any person, to park or stand anywhere in such parking area for a period in excess of two hours at any one time, in any one parking stall, as follows
(a)
In reference to the municipal parking lot on the east side of Ocean Avenue from Cliff Avenue to the northerly boundary of the Borough of Bradley Beach:

Except for times otherwise controlled by Chapter 335 of these ordinances, Parking Regulated, it shall be unlawful and a violation of this chapter for any person to cause, allow, permit or suffer any vehicle of any kind or nature, registered in the name of, or operated by such person, or placed or driven thereon by any person, to park or stand anywhere in such parking area for a period in the excess of two hours at any one time between the hours of 9:00 a.m. and 5:00 p.m.

It shall be unlawful and a violation of this chapter for any person to park any vehicle in said parking lot between the hours of 10:00 p.m. and 5:00 a.m.
(b)
In reference to the municipal parking lot around the Borough Hall, including the parking areas on all of the land immediately adjacent to and surrounding the Borough Hall, located at the northwest corner of Main Street and LaReine Avenue, and including all of that area adjacent to and contiguous with the northerly and westerly sides of the Borough Hall, including the entrances thereto and exits therefrom:

Public parking. All 28 parking spaces (plus two handicapped spaces) in the municipal parking area immediately north of the Borough Hall shall be available for "Public" parking, subject to a two-hour time limit, Monday through Sunday, between 5:00 a.m. to 10:00 p.m. daily, subject to the following "Employee-Only" parking exceptions:
[i]
Eight spaces, plus one handicapped space, along the northern wall of the Borough Hall shall be designated "Employee-Only" parking, Monday through Friday, from 5:00 a.m. to 4:00 p.m. The two-hour limit will not apply to these spaces during "Employee-Only" parking hours.
[ii]
Six of the parking spaces in the "center" of the municipal parking area north of the Borough Hall; specifically, the three most westerly spaces in each of the two center rows, shall be designated "Employee-Only" parking, Monday through Friday, from 5:00 a.m. to 4:00 p.m. The two-hour limit will not apply to these spaces during "Employee-Only" parking hours.

It shall be unlawful and violation of this chapter for any person to park any vehicle in the parking areas immediately adjacent to and surrounding the Borough Hall between the hours of 12:00 a.m. and 5:00 a.m. on any day of the week without authorized permission.
2.
To cause, allow or permit any vehicle to park or stand across any line or marking of a parking stall on or in such position that the vehicle shall not be entirely within the area designated by such lines and markings.
3.
To cause, allow or permit any vehicle to park or stand in any designated portion of a parking area or in any parking stall which has been or is hereafter designated by appropriate marking or signs as a "no parking" area.
4.
To permit or allow any vehicle to stand or be parked, nor shall any person stand or park any vehicle upon any roadway within the Borough, for the purpose of making any repairs in, upon or to any such vehicle except such repairs that are necessitated by an immediate emergency. The foregoing shall apply with equal force and effect to any person permitting or performing any of the foregoing prohibited actions or services whether he be the owner of the vehicle or a person having custody of the vehicle or any person performing any of the foregoing.
5.
To cause, allow, permit or suffer any vehicle along Ocean Avenue (County Route 18), attended or unattended, to stop or park up to a crosswalk or sideline of a street or intersecting highway other than in accordance with authorized signs, pavement markings, or other traffic control devices, unless necessary to avoid conflict with other traffic or in compliance with law or direction of any law enforcement officer or other person authorized to enforce these rules.
6.
To cause, allow, permit or suffer any vehicle on all intersections on any and all public roadways within the Borough of Bradley Beach attended or unattended to stop or park within 10 feet of a crosswalk or sideline of a street intersecting highway other than in accordance with authorized signs, pavement markings, or other control devices, unless necessary to avoid conflict with other traffic or in compliance with law or direction of any law enforcement officer or other person authorized to enforce these rules. (Exception: in a school zone, no parking within 25 feet of a crosswalk or sideline of a street or intersecting highway or within 50 feet of a stop sign in a school zone during hours when school is in session.)
b.
Trucks and buses; overnight parking of commercial vehicles on public streets. It shall be unlawful to park on any of the streets, roads or highways of the Borough between 12:00 midnight and 5:00 a.m. any of the following vehicles or equipment:
1.
Buses.
2.
Bulldozers, tractors, cement mixers, dump trucks, tow trucks, rear dual wheeled or rack body trucks.
3.
Boats, boat trailers, jet skis, or any non-motor vehicles.
4.
Trailers of any type.
5.
Campers and recreational vehicles.
6.
Any vehicle longer than 23 feet.
7.
Commercially registered vehicles weighing in excess of 10,000 pounds.
8.
All vehicles that contain exposed pipes, ropes, wire and/or more than one exposed ladder, or other type of construction or maintenance equipment located on either the top or the side(s) of the vehicle.
c.
The occupant of a property who has a commercial vehicle that is registered as a car or a van under 23 feet who does not have driveway, as confirmed by the Police Department, may apply for a Borough-issued permit (permits limited to one per household) that allows for street parking during the restricted hours.
d.
Parking of large commercial vehicles in residential areas. There shall be no parking of large commercial vehicles at any time in residential areas except when engaged in loading, unloading or only the hours when work is being performed in a residential area. Larger commercial vehicles are defined as any vehicle used primarily for commercial purposes and weighing over 10,000 pounds including but not limited to tractor-trailers, cab-part of trailers or any vehicle with a trailer attached thereto, with or without commercial plates.
e.
Removal of vehicle. Any vehicle found parked or standing in a parking area in violation of any of the provisions of this chapter may be removed by towing or otherwise by any member of the Police Department or other duly authorized agents of the Borough and may be taken to any lawful place and kept until claimed by the owner or person having possession, custody or control of the vehicle. Any garage keeper or other person engaged in the business of towing and storing automobiles may be employed or engaged for the purpose of removing and keeping any such vehicle. Any person who shall cause, allow or permit any vehicle to park or stand in a parking area in violation of any of the provisions herein shall by so doing be deemed to designate, constitute and appoint the Borough the agent and attorney of such person for the purpose of removing and keeping such vehicle as herein provided and further shall be deemed to release the Borough from and to waive any and all claims for damages of any nature whatsoever arising out of the removal and keeping or storing of such vehicle and shall be liable for the payment of all reasonable fees and other charges and expenses incurred by reason of the removal by towing or otherwise and the keeping or storing of such vehicle.
9-3.7
Parking of trucks, buses, commercial vehicles and campers prohibited on Ocean Avenue.

9-3.9
Except when necessary to avoid conflict with other traffic or in compliance with the directions of a traffic or police officer or traffic sign or signal, no operator of a vehicle shall stand or park a vehicle in any space on public or private property appropriately marked for vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197 et seq., or any other applicable law unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or passenger in that vehicle. State, county or municipal law enforcement officers or parking enforcement authority officers shall enforce the parking restrictions on spaces appropriately marked for vehicles for the physically handicapped or special permit parking spaces on both public and private property. Any person violating this subsection by parking or standing a motor vehicle in an appropriately marked restricted parking space without a special vehicle identification card shall be subject to a mandatory court appearance and a minimum fine of $300, with a maximum fine of $1,500, and up to 90 days of community service on such terms and in such form as the court shall deem appropriate.

a.
Eligibility for special parking permits.
1.
The applicant's dwelling must be their primary residence in the Borough of Bradley Beach to apply for a 12 month permit, or they may apply for a six month permit if their primary residence is not in the Borough of Bradley Beach.
2.
The applicant's property must have no driveway, curb cut, garage, or other form of off-street parking access. Any question related to availability of off-street parking with be resolved by review and determination of the Bradley Beach Police Department.
4.
The applicant must provide a "Physician's Attestation Form" completed by their attending physician, as provided by the Borough, within the 90 days prior to the application.
5.
The applicant must demonstrate that the proposed special permit parking space is located on a municipal roadway. The Borough will not make any applications to state, county, or other agencies on behalf of any applicant.
6.
A caregiver (or caregivers) may be approved for use of the special permit space if they provide documentation of caregiver support for at least 30 hours per week for a period of at least three months at the disabled applicant's residence in Bradley Beach.
b.
Administrative requirements.
1.
In November of each year, special parking permit applications will be made available by the Borough. All applications must be received prior to January 1. All permits expire the last day of December of each year.
2.
All applications will be reviewed by the Police Department, and permits will be issued by the Chief of Police, for a January 1 effective date, if eligibility requirements are satisfied.
3.
Off-calendar year special parking permit applications will be considered by the Police Department if accessibility conditions change substantially after January 1.
4.
Each permit holder must display both a valid New Jersey Motor Vehicle Commission-issued disability placard (or equivalent from another state) and the Bradley Beach special "handicapped" parking permit decal. The decal must be positioned on the street side and rear window of the vehicle when it is parked in the designated space.
5.
Upon approval, the Borough will designate a parking space in close proximity to the applicant's residence that is deemed to be the most safe and efficient to facilitate entrance and exit.
6.
The special parking permit issued by the Borough is nontransferable.
7.
Parking spaces shall be a minimum of 20 feet and a maximum of 23 feet in length.
8.
Only one car can be designated to park in the designated parking space, exceptions will be considered for multiple caregivers.
9.
Holders of special parking permits may park only within the designated space while parked on the block on which they reside. A designated space will be identified by signage, either twelve-month (January 1 through December 31) or six-month (April 15 through October 15), and delineated lines on the street.
10.
There shall be a nonrefundable, annual application fee of $100 to cover the costs of administration, signage, and maintenance.
9-3.11
Parking for concessions on Ocean Avenue. The Borough of Bradley Beach reserves unto itself the right to designate one parking place along the easterly side of Ocean Avenue for each concession it leases along the oceanfront. The Borough finds that this parking place is needed to aid in the use of the concessions. The Mayor and Council may, by resolution, allocate one parking place per concession by the adoption of a resolution setting forth the terms and conditions of use by the concession owner.

9-3.12
Parking on Ocean Avenue for First Aid Department members. There is hereby established two parking spaces located on the easterly side of Ocean Avenue at the intersection of Park Place, two parking spaces on the westerly side of Ocean Avenue at the intersection of Second Avenue, one parking space on the easterly side of Ocean Avenue at the intersection of Brinley Avenue for the exclusive use of active members of the Bradley Beach First Aid Department for parking. Bradley Beach First Aid members shall provide on their vehicles identification designating them active members of the First Aid Department.

Limited parking adjacent to First Aid Building.

a.
There is hereby established limited parking on the south side of the First Aid Building located at 725 Main Street, Bradley Beach 07720, in the designated areas for First Aid Members parking only. Said parking spaces shall be designated for First Aid Members only. This shall include five parking spaces.
b.
Parking in the designated areas by any other than by members of the First Aid Squad is prohibited.
c.
Any persons who park in violation of this subsection may have their vehicle towed away at the sole expense of the owner and/or fined up to $100.
9-3.14
Limited parking at Bradley Beach Fire House.

a.
There is hereby established limited parking on the property known as the "Bradley Beach Fire Station" located at 815 Main Street, Bradley Beach, New Jersey, 07720, from the entrance south of the fire station to the exit north of the fire station in the designated area for Fire Department functions only.
b.
Said parking shall be designated for Fire Department functions only. This shall include all parking spaces located on the property bounded by the aforementioned entrance and exit.
c.
Parking in the designated area by any other than person or persons not involved in an approved Fire Department function shall be prohibited.
d.
Any person or persons who park in violation of this subsection may have their vehicle towed away at the sole expense of the owner and/or be fined up to $100.

Trucks over four tons' gross weight are hereby excluded from the streets or parts of streets described in Schedule IV attached to and made a part of this chapter, except for the pickup and delivery of materials.
9-4.1
Limiting the use of parts of streets to certain designated use and for certain types of vehicles. The following locations are hereby designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces, namely:
a.
On the easterly side of Ocean Avenue beginning at a point 93 feet north from the extension of the northerly curbline of Cliff Avenue and extending in a northerly direction for a distance of 22 feet.
b.
On the easterly side of Ocean Avenue beginning at a point 133 feet south from the extension of the southerly curbline of Second Avenue and extending in a southerly direction for a distance of 22 feet.
c.
On the easterly side of Ocean Avenue beginning at a point 142 feet north from the extension of the northerly curbline of LaReine Avenue and extending in a northerly direction for a distance of 22 feet.

The streets or parts of streets described in Schedule V attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VI attached to and made a part of this chapter are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street except where yield signs are provided for in the designation.

Pursuant to the provisions of N.J.S.A. 39:4-135, angle parking is permitted on the streets or parts of streets described in Schedule VII attached to and made a part of this chapter.

The Mayor shall, if he finds that a safety problem exists for ingress and egress to any public or private school or for the provision of recreational facilities for children attending such school, or both, due to lack of a suitable area surrounding the school, close by regulation any portion of any street within the block upon which such school is located to the use of through traffic during such time as he shall determine, not to exceed one hour between 7:30 a.m. and 10:30 a.m., two hours between 11:00 a.m. and 2:00 p.m. and one hour between 2:30 p.m. and 4:30 p.m., on any days which such school is in session and permit the use of the portion of the street, during set hours, for ingress and egress to such school, and for the use of the pupils of such school for recreational purposes, under proper supervision and provide adequate police facilities for such supervision and for the control of traffic upon such portion of the street. Proper warning signs shall be posted indicating the street is so closed and the purpose thereof, during the time when the same is so closed.

The following areas on Main Street are hereby designated as bus stops:
1.
On the easterly side of Main Street between the northerly curbline of Ocean Park Avenue and a point distant 50 feet northerly therefrom, for northbound buses.
2.
On the westerly side of Main Street for a distance of 80 feet southerly from a point distant 12 feet nine inches southerly from the extension of the southerly curbline of Ocean Park Avenue, for southbound buses.
3.
On the easterly side of Main Street between the northerly curbline of LaReine Avenue and a point distant 54 feet northerly therefrom, for northbound buses.

On the westerly side of Main Street between the southerly curbline of LaReine Avenue and a point distant 80 feet southerly therefrom, for southbound buses.

No vehicle shall be parked or stop within the limits of any of the hereinabove designated bus stops except for the purpose of taking on or discharging passengers, and no vehicle shall remain standing in any of said bus stops for a longer period of time than necessary for the purpose of taking on or discharging of passengers.

Any person convicted of a violation of this chapter, or any supplement thereto, shall be liable to a penalty not to exceed the current fine provided for by New Jersey statute in compliance with N.J.S.A. 39:4-203 or imprisonment for a term not exceeding 15 days, or both.

9-11.1
Declaration of snow emergency. Whenever snow is covering the streets or highways within the Borough, and upon declaration by the Director of Public Works or his or her designee, the following temporary parking prohibitions and requirements shall take effect and remain in effect until terminated as provided herein.
a.
Streets running east-west.
1.
During snowfall and until plowing operations are completed, parking of all vehicles on the south side of any street running east and west is prohibited.
2.
Upon cessation of snowfall and completion of plowing on the south side of such streets, vehicles shall be parked on the south side thereof, and parking on the north side of such streets shall be prohibited until the roadway has been plowed sufficiently so as not to interfere with the normal flow of traffic.
b.
Streets running north-south.
1.
During snowfall and until plowing operations are completed, parking of all vehicles on the east side of any street running north and south is prohibited.
2.
Upon cessation of snowfall and completion of plowing on the east side of such streets, vehicles shall be parked on the east side thereof, and parking on the west side of such streets shall be prohibited until the roadway has been plowed sufficiently so as not to interfere with the normal flow of traffic.
c.
Duration and notice. The parking prohibitions established herein shall remain in effect until snowfall has ceased and the streets have been plowed for the full width of the roadway and to an extent that parking does not interfere with the normal flow of traffic. The Borough shall not be required to provide notice of such restrictions; however, reasonable efforts may be made to communicate when alternate-side parking requirements commence and when parking requirements shift.
d.
Off-street parking during snow emergency. During a declared snow emergency, where off-street parking is available, no vehicle shall be parked on any public street.
9-11.3
Towing and removal of vehicles. Any vehicle parked in violation of this section, or abandoned on a public street, shall be deemed a nuisance and a menace to public safety. Any authorized public safety officer may provide for the removal of such vehicle. The owner shall pay all reasonable costs of towing and storage prior to redemption.
9-11.4
Sidewalk snow and ice removal.
a.
Any owner, occupant, tenant, building superintendent, rental agent, or other person in charge of premises abutting or bordering upon any public street within the Borough shall remove all snow and ice from the abutting sidewalks within 24 hours after the same snow and/or ice has fallen or has formed thereon. Where ice is so frozen as to make removal impracticable, the same shall be thoroughly covered with sand or other suitable abrasive material.

For properties located on corner lots, the duty imposed herein shall expressly include the removal of snow and ice from all sidewalks abutting the premises on both intersecting streets, including but not limited to sidewalks at the intersection, pedestrian crosswalk approaches, driveway aprons, and all curb ramps, handicapped access ramps, landing areas, and detectable warning surfaces adjoining or serving the property.

Snow and ice shall be removed so as to provide and maintain a continuous, unobstructed pedestrian path of travel not less than 36 inches in clear width, measured exclusive of vertical obstructions, for the full length of the abutting sidewalks. Such clearance shall extend across the full usable width and running slope of all curb ramps and across associated landing areas at the top and bottom of each ramp. The required clear path shall be consistent with the minimum clear width for an accessible route as defined under the Americans with Disabilities Act (ADA),[1] including but not limited to applicable provisions of the 2010 ADA Standards for Accessible Design, as may be amended.

b.
The obligations set forth herein are mandatory. Failure to clear and maintain such areas within the time period prescribed in this section shall constitute a separate and distinct violation for each frontage and for each day the condition remains uncorrected. The Borough may, in addition to issuing summonses and penalties as otherwise provided in this chapter, cause the removal of snow and ice and assess the cost thereof as a lien against the property in the manner provided by law.
9-11.5
Depositing snow on streets prohibited. No person, firm, or corporation, nor any owner, tenant, or occupant of property abutting a public street, shall throw, place, or deposit snow or ice from private property onto any public street or sidewalk within the Borough.
9-11.6
Penalties; enforcement. Any person who violates any provision of this section shall, upon conviction, be subject to the penalties set forth in § 1-5, General Penalty, of the Code of the Borough of Bradley Beach. In addition, the Police Department is authorized to tow vehicles parked in violation of this section at the owner's expense. Each day that a violation of this section continues shall constitute a separate and distinct offense.

Purpose. This section authorizes the placement of in-street pedestrian crossing right-of-way signs as authorized by N.J.S.A. 39:4-8d at the intersection of Lake Terrace (CR 18) and the following municipal cross streets:
