§ 9-1 Words and phrases.

Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

§ 9-2 Official time standard.

Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time, as may be in current use in the Borough.

§ 9-3 Parking. [1]

9-3.1 Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

9-3.2 Parking prohibited during state of emergency.

a. Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

b. Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before gaining possession of the vehicle.

c. The effectiveness of this subsection is contingent upon signs being erected as required by law.

9-3.3 Parking prohibited at all times on certain streets. No person shall park a vehicle at any time upon any of the streets or parts of streets described in Schedule I attached to and made a part of this chapter.

9-3.4 Parking prohibited during certain hours on certain streets. No person shall park a vehicle between the hours specified upon any of the streets or parts of streets described in Schedule II attached to and made a part of this chapter.

9-3.5 Parking time limited on certain streets. No person shall park a vehicle for longer than the time limit designated at any time between the hours limited, upon any of the streets or parts of streets described in Schedule III attached to and made a part of this chapter.

9-3.5A Parking time limited at Bradley Beach Grammar School.

a. It is the intention of the Mayor and Council to provide for the safety of its citizens and children and to establish an area along Fifth Avenue and Hammond Avenue adjacent to the Borough Grammar School in the Borough of Bradley Beach for the loading and unloading of children during school hours.

b. Except as otherwise provided at all times and on all days when school is in session, it shall be unlawful to park on the north side of Fifth Avenue or east side of Hammond Avenue along the side of the school property where posted from 7:30 a.m. to 4:00 p.m.

c. On the north side of Fifth Avenue alongside the school, it shall be lawful to stand or park a vehicle for the sole purpose of loading and unloading of children going to and coming from the school. In no event shall a vehicle remain in the loading and unloading zone for a period of longer than three minutes.

9-3.6 Rules and regulations.

a. Violations. It shall be unlawful and a violation of this chapter for any person:

1. To cause, allow, permit or suffer any vehicle of any kind or nature, registered in the name of, or operated by such person, or placed or driven thereon by any person, to park or stand anywhere in such parking area for a period in excess of two hours at any one time, in any one parking stall, between the hours of 9:00 a.m. and 5:00 p.m. on any Monday, through and including Friday, of any week during the year. The aforesaid parking period limitation shall not apply in the area known and designated as "reserved area." This provision is applicable to:

(a) In reference to the municipal parking lot on the east side of Ocean Avenue from Cliff Avenue to the northerly boundary of the Borough of Bradley Beach:

[1] Except for times otherwise controlled by Chapter 335 of these ordinances, Parking Meters, it shall be unlawful and a violation of this chapter for any person to cause, allow, permit or suffer any vehicle of any kind or nature, registered in the name of, or operated by such person, or placed or driven thereon by any person, to park or stand anywhere in such parking area for a period in the excess of two hours at any one time between the hours of 9:00 a.m. and 5:00 p.m.

[2] It shall be unlawful and a violation of this chapter for any person to park any vehicle in said parking lot between the hours of 10:00 p.m. and 5:00 a.m.

(b) In reference to the municipal parking lot on the north and west sides of Borough Hall:

[1] Only Borough Office employees shall be permitted to park in the designated spaces next to Borough Hall Building between the hours of 5:00 a.m. and 5:00 p.m. Monday through Friday.

[2] Center 18 parking spots in the Borough Hall lot shall be available for public parking with a two-hour time parking limit Sunday through Saturday 8:00 a.m. to 6:00 p.m.

[3] It shall be unlawful and violation of this chapter for any person to park any vehicle in said lot between the hours of 12:00 a.m. and 5:00 a.m. on any day of the week without authorized permission.

2. To cause, allow or permit any vehicle to park or stand across any line or marking of a parking stall on or in such position that the vehicle shall not be entirely within the area designated by such lines and markings.

3. To cause, allow or permit any vehicle to park or stand in any designated portion of a parking area or in any parking stall which has been or is hereafter designated by appropriate marking or signs as a "no parking" area.

4. To permit or allow any vehicle to stand or be parked, nor shall any person stand or park any vehicle upon any roadway within the Borough, for the purpose of making any repairs in, upon or to any such vehicle except such repairs that are necessitated by an immediate emergency. The foregoing shall apply with equal force and effect to any person permitting or performing any of the foregoing prohibited actions or services whether he be the owner of the vehicle or a person having custody of the vehicle or any person performing any of the foregoing.[2]

5. To cause, allow, permit or suffer any vehicle along Ocean Avenue (County Route 18), attended or unattended, to stop or park up to a crosswalk or sideline of a street or intersecting highway other than in accordance with authorized signs, pavement markings, or other traffic control devices, unless necessary to avoid conflict with other traffic or in compliance with law or direction of any law enforcement officer or other person authorized to enforce these rules.

6. To cause, allow, permit or suffer any vehicle on all intersections on any and all public roadways within the Borough of Bradley Beach attended or unattended to stop or park within 10 feet of a crosswalk or sideline of a street intersecting highway other than in accordance with authorized signs, pavement markings, or other control devices, unless necessary to avoid conflict with other traffic or in compliance with law or direction of any law enforcement officer or other person authorized to enforce these rules. (Exception: in a school zone, no parking within 25 feet of a crosswalk or sideline of a street or intersecting highway or within 50 feet of a stop sign in a school zone during hours when school is in session.)

b. Trucks and buses; overnight parking of commercial vehicles on public streets. It shall be unlawful to park on any of the streets, roads or highways of the Borough between 12:00 midnight and 5:00 a.m. any of the following vehicles or equipment:

1. Buses.

2. Bulldozers, tractors, cement mixers, dump trucks, tow trucks, rear dual wheeled or rack body trucks.

3. Boats, boat trailers, jet skis, or any non-motor vehicles.

4. Trailers of any type.

5. Campers and recreational vehicles.

6. Any vehicle longer than 23 feet.

7. Commercially registered vehicles weighing in excess of 10,000 pounds.

8. All vehicles that contain exposed pipes, ropes, wire and/or more than one exposed ladder, or other type of construction or maintenance equipment located on either the top or the side(s) of the vehicle.

c. The occupant of a property who has a commercial vehicle that is registered as a car or a van under 23 feet who does not have driveway, as confirmed by the Police Department, may apply for a Borough-issued permit (permits limited to one per household) that allows for street parking during the restricted hours.

d. Parking of large commercial vehicles in residential areas. There shall be no parking of large commercial vehicles at any time in residential areas except when engaged in loading, unloading or only the hours when work is being performed in a residential area. Larger commercial vehicles are defined as any vehicle used primarily for commercial purposes and weighing over 10,000 pounds including but not limited to tractor-trailers, cab-part of trailers or any vehicle with a trailer attached thereto, with or without commercial plates.

e. Removal of vehicle. Any vehicle found parked or standing in a parking area in violation of any of the provisions of this chapter may be removed by towing or otherwise by any member of the Police Department or other duly authorized agents of the Borough and may be taken to any lawful place and kept until claimed by the owner or person having possession, custody or control of the vehicle. Any garage keeper or other person engaged in the business of towing and storing automobiles may be employed or engaged for the purpose of removing and keeping any such vehicle. Any person who shall cause, allow or permit any vehicle to park or stand in a parking area in violation of any of the provisions herein shall by so doing be deemed to designate, constitute and appoint the Borough the agent and attorney of such person for the purpose of removing and keeping such vehicle as herein provided and further shall be deemed to release the Borough from and to waive any and all claims for damages of any nature whatsoever arising out of the removal and keeping or storing of such vehicle and shall be liable for the payment of all reasonable fees and other charges and expenses incurred by reason of the removal by towing or otherwise and the keeping or storing of such vehicle.

f. Parking areas and reserved areas. The word or words "parking area" shall mean and include all of the lot and area, which is hereby designated as a parking lot, and which area shall include all of that land and area immediately adjacent to and contiguous with the total northerly side of the municipal building (Borough Hall) at the northwest corner of Main Street and LaReine Avenue, in the Borough of Bradley Beach, and including all of that area adjacent to and contiguous with the westerly side of the municipal building including the entrances thereto and exits therefrom, it being the intention to include in the parking area all of the land surrounding the municipal building as aforesaid which is owned by the Borough of Bradley Beach.

9-3.7 Parking of trucks, buses, commercial vehicles and campers prohibited on Ocean Avenue.

9-3.9 Special permit parking. Except when necessary to avoid conflict with other traffic or in compliance with the directions of a traffic or police officer or traffic sign or signal, no operator of a vehicle shall stand or park a vehicle in any space on public or private property appropriately marked for vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197 et seq. or any other applicable law unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or passenger in that vehicle. State, county or municipal law enforcement officers or parking enforcement authority officers shall enforce the parking restrictions on spaces appropriately marked for vehicles for the physically handicapped or special permit parking spaces on both public and private property. Any person violating this subsection by parking or standing a motor vehicle in an appropriately marked restricted parking space without a special vehicle identification card shall be subject to a mandatory court appearance and a minimum fine of $250, with a maximum fine of $1,250, and up to 90 days of community service on such terms and in such form as the court shall deem appropriate.

a. Special parking permits.

1. In January of each year, special parking permit applications will be made available by the Borough of Bradley Beach. All applications and payment must be received by the Borough by January 31 of each year. All permits expire the last day of December of each year.

2. All applications will be reviewed during the month of January by the Police Department and the applications deemed to be compliant will receive permits with the provisions in this section issued by the Chief of Police.

3. Each individual must display the Bradley Beach special parking permit decal on the street side and on the rear window of the vehicle when it is parked in the designated space.

4. The special parking permit issued by the Borough of Bradley Beach is nontransferable.

5. The permit seeker must have a current handicapped placard, a disabled-person ID registration issued by the state of their permanent residence and a physician's note issued within the 90 days prior to the application in order to continue the use of a designated special parking space.

6. Only one designated special parking space per household will be approved by the Borough of Bradley Beach.

7. Unrestricted use of a driveway and/or garage at the residential site shall be cause for denial of continued use of a special parking space.

8. Parking spaces shall be a minimum of 20 feet in length and a maximum of 23 feet.

9. In order for a caregiver of the individual to obtain a permit, this caregiver must live in the residence with the handicapped individual.

10. Only one car can be designated to park in the designated parking space.

11. Holders of special parking permits may park only within the designated space while parked on the block on which they reside.

b. There shall be a nonrefundable, annual application fee of $50. Applications for renewals must be received by the close of business on January 31. For renewal applications, if payment is not received by the close of business on January 31, the designated permit parking space will be considered abandoned.

9-3.11 Parking for concessions on Ocean Avenue. The Borough of Bradley Beach reserves unto itself the right to designate one parking place along the easterly side of Ocean Avenue for each concession it leases along the oceanfront. The Borough finds that this parking place is needed to aid in the use of the concessions. The Mayor and Council may, by resolution, allocate one parking place per concession by the adoption of a resolution setting forth the terms and conditions of use by the concession owner.

9-3.12 Parking on Ocean Avenue for First Aid Department members. There is hereby established two parking spaces located on the easterly side of Ocean Avenue at the intersection of Park Place, two parking spaces on the westerly side of Ocean Avenue at the intersection of Second Avenue, one parking space on the easterly side of Ocean Avenue at the intersection of Brinley Avenue for the exclusive use of active members of the Bradley Beach First Aid Department for parking. Bradley Beach First Aid members shall provide on their vehicles identification designating them active members of the First Aid Department.

9-3.13 Limited parking adjacent to First Aid Building.

a. There is hereby established limited parking on the south side of the First Aid Building located at 725 Main Street, Bradley Beach 07720, in the designated areas for First Aid Members parking only. Said parking spaces shall be designated for First Aid Members only. This shall include five parking spaces.

b. Parking in the designated areas by any other than by members of the First Aid Squad is prohibited.

c. Any persons who park in violation of this subsection may have their vehicle towed away at the sole expense of the owner and/or fined up to $100.

9-3.14 Limited parking at Bradley Beach Fire House.

a. There is hereby established limited parking on the property known as the "Bradley Beach Fire Station" located at 815 Main Street, Bradley Beach, New Jersey, 07720, from the entrance south of the fire station to the exit north of the fire station in the designated area for Fire Department functions only.

b. Said parking shall be designated for Fire Department functions only. This shall include all parking spaces located on the property bounded by the aforementioned entrance and exit.

c. Parking in the designated area by any other than person or persons not involved in an approved Fire Department function shall be prohibited.

d. Any person or persons who park in violation of this subsection may have their vehicle towed away at the sole expense of the owner and/or be fined up to $100.

§ 9-4 Limiting the use of streets to certain class of vehicles.

Trucks over four tons' gross weight are hereby excluded from the streets or parts of streets described in Schedule IV attached to and made a part of this chapter, except for the pickup and delivery of materials.

9-4.1 Limiting the use of parts of streets to certain designated use and for certain types of vehicles. The following locations are hereby designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces, namely:

a. On the easterly side of Ocean Avenue beginning at a point 93 feet north from the extension of the northerly curbline of Cliff Avenue and extending in a northerly direction for a distance of 22 feet.

b. On the easterly side of Ocean Avenue beginning at a point 133 feet south from the extension of the southerly curbline of Second Avenue and extending in a southerly direction for a distance of 22 feet.

c. On the easterly side of Ocean Avenue beginning at a point 142 feet north from the extension of the northerly curbline of LaReine Avenue and extending in a northerly direction for a distance of 22 feet.

9-4.2 Limiting parking on parts of a certain designated alley, described as follows:

	BEING known and designated as Lots 24-A, part of 24-B and part of 24-C in Block 32 on the tax assessment map of the Borough of Bradley Beach, and being more particularly described as follows:
	BEGINNING at a point in the northerly line of LaReine Avenue distant 124.28 feet westerly from the point formed by the intersection, of the westerly line of Main Street with the northerly line of LaReine Avenue; thence (1) northerly and parallel with said Main Street 356.70 feet, more or less, to a point in the southerly line of lands now or formerly of the Jersey Central Power and Light Company; thence (2) easterly and along the southerly lines of lands of said Jersey Central Power and Light Company, and on a line which is the southerly line of Lot 7 in Block 32 on said Map if extended westerly, a distance of 25 feet to the easterly line of a road being on a line which is the westerly line of Lots 1 and 2 in Block 32 of said map if extended northerly; thence (3) southerly and parallel with said Main Street and along a line which is the westerly line of Lots 1 and 2 if extended northerly and along the westerly line of said Lots 1 and 2, 356.30 feet, more or less, to a point in the northerly line of said LaReine Avenue; thence (4) westerly, and along the northerly line of LaReine Avenue, 25.06 feet to the point and place of BEGINNING.
	Parking shall be prohibited on the westerly side of the aforementioned unnamed alley for all vehicles at all times.

§ 9-5 One-way streets.

The streets or parts of streets described in Schedule V attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.

§ 9-6 Through streets.

[Amended 8-27-1957; 6-5-1968; 4-27-1971]

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VI attached to and made a part of this chapter are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street except where yield signs are provided for in the designation.

§ 9-7 Angle parking.

[Amended 8-27-1957]

Pursuant to the provisions of N.J.S.A. 39:4-135, angle parking is permitted on the streets or parts of streets described in Schedule VII attached to and made a part of this chapter.

§ 9-8 Temporary closing of streets.

[Amended 3-11-1975]

The Mayor shall, if he finds that a safety problem exists for ingress and egress to any public or private school or for the provision of recreational facilities for children attending such school, or both, due to lack of a suitable area surrounding the school, close by regulation any portion of any street within the block upon which such school is located to the use of through traffic during such time as he shall determine, not to exceed one hour between 7:30 a.m. and 10:30 a.m., two hours between 11:00 a.m. and 2:00 p.m. and one hour between 2:30 p.m. and 4:30 p.m., on any days which such school is in session and permit the use of the portion of the street, during set hours, for ingress and egress to such school, and for the use of the pupils of such school for recreational purposes, under proper supervision and provide adequate police facilities for such supervision and for the control of traffic upon such portion of the street. Proper warning signs shall be posted indicating the street is so closed and the purpose thereof, during the time when the same is so closed.

§ 9-9 Bus stops.

a. The following areas on Main Street are hereby designated as bus stops:

1. On the easterly side of Main Street between the northerly curbline of Ocean Park Avenue and a point distant 50 feet northerly therefrom, for northbound buses.

2. On the westerly side of Main Street for a distance of 80 feet southerly from a point distant 12 feet nine inches southerly from the extension of the southerly curbline of Ocean Park Avenue, for southbound buses.

3. On the easterly side of Main Street between the northerly curbline of LaReine Avenue and a point distant 54 feet northerly therefrom, for northbound buses.

4. On the westerly side of Main Street between the southerly curbline of LaReine Avenue and a point distant 80 feet southerly therefrom, for southbound buses.

5. On the easterly side of Main Street between the northerly curbline of Brinley Avenue and a point distant 50 feet northerly therefrom, for northbound buses.

6. On the westerly side of Main Street between the northerly curbline of Brinley Avenue and a point distant 80 feet northerly therefrom, for southbound buses.

7. On the easterly side of Main Street between the northerly curbline of Fourth Avenue and a point distant 80 feet northerly therefrom, for northbound buses.

8. On the westerly side of Main Street between the southerly curbline of Fourth Avenue and a point distant 80 feet southerly therefrom, for southbound buses.

9. On the easterly side of Main Street between the northerly curbline of Evergreen Avenue and a point distant 80 feet northerly therefrom, for northbound buses.

10. On the westerly side of Main Street between the southerly side of Evergreen Avenue and a point distant 80 feet southerly therefrom, for southbound buses.

b. No vehicle shall be parked or stop within the limits of any of the hereinabove designated bus stops except for the purpose of taking on or discharging passengers, and no vehicle shall remain standing in any of said bus stops for a longer period of time than necessary for the purpose of taking on or discharging of passengers.

§ 9-10 Penalty.

Any person convicted of a violation of this chapter, or any supplement thereto, shall be liable to a penalty not to exceed the current fine provided for by New Jersey statute in compliance with N.J.S.A. 39:4-203 or imprisonment for a term not exceeding 15 days, or both.

§ 9-11 Temporary no parking for snow removal.

9-11.1 Whenever there is snow covering on the streets or highways in the Borough, in the discretion of the Superintendent of Public Works or his designee, the following prohibitions will take effect:

a. Parking of all vehicles on the south side of the street on any street which runs east and west is prohibited until after the snow has stopped and the street has been plowed; then, after the snow has stopped and the south side of the street has been plowed, park the vehicles on the south side of the street on any street which runs east and west until the streets have been plowed sufficiently and to the extent that parking will not interfere with normal flow of traffic.

b. Parking of all vehicles on the east side of the street on any street which runs north and south is prohibited until after the snow has stopped and the street has been plowed; then, after the snow has stopped and the east side of the street has been plowed, park the vehicles on the east side of the street on any street which runs north and south until the streets have been plowed sufficiently and to the extent that parking will not interfere with normal flow of traffic.

c. Any vehicle parked in violation or abandoned on a public street shall be deemed to be a nuisance and a menace to public safety and any public safety officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage of a vehicle before redeeming possession thereof.

d. This parking prohibition shall remain in effect until after the snow has ceased and the streets have been plowed for the full width as well as until parking will not interfere with the normal flow of traffic.

e. During a snow emergency, if off-street parking is available, any vehicle shall not be parked on any street.

f. Any owner or owners, occupant or occupants, tenant or tenants, building superintendent, rental agent or person in charge of premises abutting or bordering upon any public street in the Borough shall remove all snow and ice from the abutting sidewalks of such streets, or in the case of ice which may be so frozen as to make removal impracticable, shall cause the same to be thoroughly covered with sand or ashes, within 24 hours of daylight after the same shall fall or be formed thereon.

9-11.2 This section shall not apply to either Main Street or Ocean Avenue as to parking of vehicles. However, the regulations regarding sidewalks shall apply.

9-11.3 The penalty provisions of § 9-10 shall apply to a violation of this ordinance. In addition, the Police Department shall have the option of towing any vehicle in violation at the owner's expense.

9-11.4 Removal costs. In addition to the provision for penalties herein made for violations of this section, and in case such snow or ice shall not be removed from such sidewalks by the owner or owners, tenant or tenants, occupant or occupants, building superintendent, rental agent or person in change of any premises, as provided in Subsection 9-11.1F, the same shall be removed forthwith and under the direction of the Supervisor of Streets, and the cost of such removal as nearly as can be ascertained shall be certified by the Supervisor of Streets to the governing body. The governing body shall examine such certification and, if found to be correct, shall cause such cost to be charged against such real estate so abutting or bordering upon such sidewalk or street, and the amount so charged shall forthwith become a lien and a tax upon such real estate or land and be added to, recorded and collected in the same manner as the taxes next to be levied and assessed upon such premises and shall bear interest and be enforced and collected by the same officers and in the same manner as other taxes.

9-11.5 Depositing snow on street restricted. No person, firm or corporation, the owner, tenant or occupant of any premises abutting on any street shall throw, place or deposit any snow or ice into or on any street in the Borough, it being the intent and purpose of this provision to prohibit all such persons from throwing, casting, placing or depositing snow and ice which accumulated on the private property abutting the street or sidewalk on the sidewalks or streets of the Borough.

§ 9-12 Installation of in-street pedestrian crossing signs at certain intersections along Lake Terrace.

9-12.1 Purpose. This section authorizes the placement of in-street pedestrian crossing right-of-way signs as authorized by N.J.S.A. 39:4-8d at the intersection of Lake Terrace (CR 18) and the following municipal cross streets:

	Fletcher Lake Avenue
	Madison Avenue
	Central Avenue
	Beach Avenue

9-12.2 Installation. The installation of the pedestrian signage shall be in accordance with the requirements of the County of Monmouth and in accordance with the guidelines promulgated by the New Jersey Department of Transportation.

§ 9-13 Placement of shield radar display units at certain intersections along Lake Terrace.

9-13.1 Purpose. This section authorizes the placement of shield radar display units in the right-of-way section along the intersection of Lake Terrace (CR 18) and the following municipal cross streets:

	Fletcher Lake Avenue
	Between Central Avenue and Madison Avenue

9-13.2 Installation. The installation of the radar display units shall be in accordance with the requirements of the County of Monmouth and in accordance with the guidelines promulgated by the New Jersey Department of Transportation.

§ 9-14 Placement of shield radar display units at certain intersections along Brinley Avenue.

9-14.1 Purpose. This section authorizes the placement of shield radar display units in the right-of-way section along the intersection of Brinley Avenue (CR 2) and the following municipal cross streets:

South side of Brinley Avenue 75 feet from the curb of Hammond Avenue

North side of Brinley Avenue 75 feet from the curb of Fletcher Lake Avenue

9-14.2 Installation. The installation of the radar display units shall be in accordance with the requirements of the County of Monmouth and in accordance with the guidelines promulgated by the New Jersey Department of Transportation.
