The Town Board of the Town of Owego, pursuant to § 271 of the Town Law, hereby increases the membership of the Planning Board of the Town of Owego from five members to seven members.
One of the additional members will be appointed for six years, and the other additional member will be appointed for seven years, and upon expiration of the term of each member of the Planning Board, his reappointment or the appointment of his successor shall be for a term of seven years.

This article shall apply to the appointment, terms, functions, and powers of alternate members appointed to the Planning Board of the Town of Owego.
It is sometimes difficult to maintain a quorum of the Planning Board because members may have a conflict of interest on a specific matter before such Board. In such an instance, official business cannot be conducted which may delay or impede adherence to required timeliness. The use of alternate members in such instances is hereby authorized pursuant to the provisions of this article.
As used in this article, the following terms shall have the meanings indicated:
ALTERNATE MEMBER
Any individual appointed by the Town Board when a regular member is unable to participate in an application or in a matter before the respective Board due to a conflict of interest, as provided herein.
MEMBER
Any individual appointed by the Town Board to serve on the Planning Board of the Town of Owego pursuant to the provisions of the local law which established such Board.
PLANNING BOARD
The Planning Board of the Town of Owego as established by the Town Board pursuant to the provisions of § 271 of the Town Law.
A. 
The Town Board of the Town of Owego hereby enacts this article to provide a process for appointing alternate members of the Planning Board of the Town of Owego. These individuals would serve when members are unable to participate on an application or a matter before the Board due to a conflict of interest.
B. 
Alternate members of the Planning Board shall be appointed by the Owego Town Board for a term of one year.
C. 
The Chairperson of the Planning Board may designate an alternate to substitute for a member when such member is unable to participate on an application or a matter before the Board due to a conflict of interest. Once so designated, the alternate member shall possess all the powers and responsibilities of such member of the Board. Such designation shall be entered into the minutes of the initial Planning Board meeting at which the substitution is made.
D. 
All provisions of state law relating to Planning Board member eligibility, vacancy in office, removal, compatibility of office, and service on other boards, as well as any provision of local law/local ordinance related to training, continuing education, compensation, and attendance, shall also apply to alternate members.
E. 
This article is adopted pursuant to Town Law § 271, Subdivision 15.
F. 
Nothing herein shall be deemed to be a waiver or restriction upon any rights and powers available to the Town of Owego to further regulate the subject matter of this article.
