A franchisee shall comply with all laws and
regulations which apply to the transmission and distribution of audio,
visual and video impulses and with all other applicable federal, state,
and Township laws and regulations as they become effective, unless
otherwise stated.
If any term, condition, or provision of this
chapter shall, to any extent, be held to be invalid or unenforceable,
the remainder hereof shall be valid in all other respects and continue
to be effective. In the event of a subsequent change in applicable
law so that the provision which had been held invalid is no longer
invalid, said provision shall thereupon return to full force and effect
without further action by the Township and shall thereafter be binding
on a franchisee and the Township.
Upon request of the Township, a franchisee shall,
at its sole expense, make available systems and related facilities
for emergency use during any emergency or disaster, in accordance
with FCC standards and requirements, as may be amended from time to
time.
Captions and headings of this chapter are for
convenience and reference purposes only and shall not affect in any
way the meaning and interpretation of any provisions of this chapter.
Unless otherwise indicated, when the performance
or doing of any act, duty, matter, payment, or thing is required hereunder
and a period of time or duration for the fulfillment of doing thereof
is prescribed and is fixed herein, the time shall be computed so as
to exclude the first and include the last day of the prescribed or
fixed period of duration time. When the last day of the period falls
on a Saturday, Sunday, or a legal holiday, that day shall not be counted
in the computation.
Upon the effective date of this chapter, Ordinance
No. 88-16 is hereby repealed.
The chapter shall become effective five days
from the date of enactment.
