It is the purpose of this chapter to protect
the public interest, welfare, health and safety within the Town of
Williamson, by prohibiting the consumption of alcoholic beverages
in public places within the town. The Town Board finds that possession
of an open container of alcoholic beverage in a public place within
the town has led to consumption of the same, resulting in public intoxication,
disorderly conduct, disturbance of the public peace, littering of
the public places and destruction of property. The Town Board finds
further that preservation of the public weal and prevention of conditions
which lead to conduct disturbing the public peace attributable to
consumption of alcoholic beverages can be accomplished by the prohibition
of consumption of alcoholic beverages in public places and by restricting
the possession of an open or unsealed container of alcoholic beverages
under circumstances which indicate that the possessor of such open
or unsealed container in a public place intends to consume the same
or intends to have it consumed by another person.
For the purpose of this chapter, the following
terms shall have the meanings herein ascribed to them; all other words
shall have the meanings normally ascribed to them.
ALCOHOLIC BEVERAGE
Includes alcohol, spirits, liquor, wine, beer, cider and
every liquid or solid, patented or not, containing alcohol, spirits,
wine or beer and capable of being consumed by a human being.
CONTAINER
Any bottle, can or receptacle suitable for or used to hold
any liquid.
PARKS
Areas owned, operated and/or controlled by the Town of Williamson
and designated by said town as having been inhabitants of the community.
PUBLIC PLACE
Any place to which the public or a substantial group of persons
has access and includes, but is not limited to, highways, streets,
transportation facilities, cemeteries, public beaches, parks, playgrounds
and other lands owned, operated or controlled by the Town of Williamson,
schools, places of amusement, shopping centers and hallways, lobbies
and other portions of apartment houses and hotels not constituting
rooms or apartments designated for actual residence.
TOWN

It shall be a violation of this chapter for any person to:
A. Consume any alcoholic beverage in any public place within the Town,
except in Town parks as expressly permitted in the Town of Williamson
Parks Law, § 32-32.
B. Have in his possession an open or unsealed container of an alcoholic
beverage while in any public place for the purpose of consuming such
alcoholic beverage by himself or by another in any public place, except
as permitted in the Town of Williamson Parks Law, § 32-32.
C. Discard alcoholic or other beverage containers upon or from any public
sidewalk, street, lane, highway, parking lot, park or recreation area
or other public property within the Town of Williamson, except in
the manner and place expressly designated for discarding trash.
This chapter shall not apply to any person consuming
alcoholic beverages in certain motor vehicles in violation of § 1227
of the Vehicle and Traffic Law of the State of New York as that section
will cover such situations.

The provisions of this chapter shall be enforced in accordance with, and the penalties for violation thereof governed by, the provisions of Chapter
1, Article
II, of this Code.
